미국의 북한인권 관련 법령 고찰 - 바이든 시대의 북한인권 관점에서 -

UN 등 국제사회에서 북한인권 문제는 이미 우리의 입장과 상관없는 확고한 상수로 자리잡았다. 다른 한편, 미국과 한국의 이전 정부에서 북한과의 북핵협상 진전을 위해 북한인권 문제에 대해서는 상대적으로 소홀히 대한 것이 아닌가 하는 비판적 견해도 존재한다. 북한과의 협상은 여전히 교착상태이며, 미국과 한국에서는 다시 새로운 정부가 출범하였다. 그런데 여기서 간과해서는 안될 점은, 특히 미국에서는, 비록 정권교체에 따라 북한인권 문제에 대한 접근에 약간의 차이가 있을 수도 있지만, 기본적으로는 초당적 문제인 북한인권 문제에 있어 공화당이나 민주당이나 미 의회의 입장은 나름의 일관성이 있으며, 각 행정부도 자신이 관련해서 해야 할 일들을 꾸준히 해오고 있다는 점이다. 이는 북한 인권법, 대북제재강화법, 국제종교자유법 및 무역법, 인신매매피해자보호법 등 의회 제정 법률 및 다양한 행정명령 등에 기반해 북한인권 문제에 대한 미국의 인식과 비판이 각종 대북 인권제재와 관련 국무부 보고서 발간 등을 통해 정부 변화와 무관하게 꾸준히 지속적으로 이어져온 점 등에서 확인될 수 있다. 즉, 의회가 초당적 이슈로 취급하며 제정한 상기 법률들이 존재하는 한, 정권교체에 따른 일부 정책 조정에도 불구, 인권, 민주주의, 정보의 자유, 난민보호 등 미국의 근본적 대북인권정책이 쉽게 변화할 수는 없는 것이다. 이에 본 논문에서는 먼저 바이든 행정부의 특징을 중심으로 미국 민주당으로의 정권 교체가 북한인권 문제에 주는 함의를 살펴보고, 그러한 정권 교체 여부와 상관없이 미국 북한인권 정책 기저에 연속적으로 작용하며 일정한 일관성을 부여하는 미국의 다양한 국내법상 북한인권 문제 규율의 구체적 내용을 함께 고찰함으로써, 여전히 어려운 상황에 처한 한반도의 현 상황 속에서 주요 관련국 미국의 내부 상황을 현실적으로 정확하게 파악하고, 또한 북한인권 문제 등 한반도 관련 사안에 대한 우리의 현명한 대처방안을 적절히 수립하는데 일정한 시사점을 찾고자 한다.
Abstract
The problem of North Korean human rights has been established as a fixed invariable in the international society, including at the UN, irrespective of the South Korean position towards it. While in the peace talks between previous governments of the US and South Korea and the North Korean regime, this question seemed to be marginalized due to their focus more on nuclear issue. However, the negotiations have reached a stalemate, and both governments, except North Korean side, have been changed. This paper points out that the US government has in fact a consistent and concerted position and practice with respect to North Korean human rights issue, based on enacted laws and regulations. The US Congress sees this issue as a bipartisan question and enacted without any objection various laws such as North Korean Human Rights Act and North Korea Sanctions and Policy Enhancement Act. In addition, International Religious Freedom Act and Trafficking Victims Protection Act have also been applied to the North Korean human rights situation. The US government accordingly monitored and issued regular reports on North Korean human rights, and recently further conducted unilateral sanctions towards responsible individuals and entities for human rights abuses in North Korea. Therefore, whether Democrat or Republican, the US government pursues their values such as human rights, democracy, freedom of information, and refugee protection, when dealing with North Korean question, firmly based on laws enacted by the US Congress. The South Korean government needs to understand its ally’s basic position very well, and reestablish its own position about North Korean human rights, based on international norms and universal principles. This kind of sound and balanced understanding may provide more feasible and durable solution for the Korean peninsula.
