유럽연합의 주된 목적은 연합 내 상거래에 있어서 여하한의 장애가 없는 역내시장의 창설이며, 기본적인 자유는 연합법상 경제헌법의 지주를 형성한다. 유럽연합은 역내시장에서 서로 다른 여러 가지의 제한을 철폐함으로써 회원국의 경제·사회적 진전을 목표로 하며, 이를 위해 자유로운 경제교류가 보장되지 않는 경우 기본적인 자유가 그 효력을 발하게 된다. 유럽연합의 활동방식에 관한 조약은 상품거래의 자유, 정주의 자유(영업소 설치·이전의 자유), 서비스거래의 자유 그리고 자본거래의 자유로 구분하고, 이러한 자유는 경제활동이 회원국의 국경을 초월하는 사례가 존재하는 경우에만 보장된다. 상품거래의 자유는 수출·입제한 및 동일한 효력을 가지는 조치를 금지하고, 그것을 통하여 자유로운 상품거래를 보장한다. 정주의 자유는 연합시민들에게 유럽공동체내에서 직장의 자유로운 선택과 관련하여 입국권과 체류권을 허용하며, 영업소설치·이전의 자유는 기업에게 기업활동의 최적지를 자유롭게 선택할 수 있는 가능성을 부여한다. 서비스거래의 자유는 국경을 초월하는 경우 서비스제공자 뿐만 아니라 서비스이용자도 보호한다. 자본거래의 자유는 금전과 모든 재산가치가 있는 권리의 자유로운 거래를 보장한다. 이러한 권리를 향유할 수 있는 주체는 유럽연합시민 즉, 회원국의 자연인과 연합 내에서 설립된 법인이지만, 예외적으로 제3국의 국적자와 법인도 향유할 수 있는 경우가 존재한다. 유럽연합과 제3국 사이에 이에 관한 협정이나 조약이 존재하는 경우에 제3국의 국적자와 법인도 기본적인 자유의 향유주체가 될 수 있음은 물론이다.
Abstract
The principal purpose of the European Union is the establishment of a common domestic market, in which barriers to trade are to be diminished. The basic freedoms form the supporting columns of the economic constitution. The preamble of the Treaty of European Community defines the economic and social progress of the member states, by removal of separating barriers, as a goal. For this purpose the basic freedoms come into force then, as soon as the free trade is no longer ensured. The Treaty on the Functioning of the EU(TFEU) differentiates between the freedom of commodity trading, the freedom of emigration or settlement, the freedom of service and the freedom of capital transactions, which protects subrange in each case of restaurant economics with transnational purchase. The freedom of commodity trading forbids import restrictions and restriction of export as well as measures of same effect and secures thus the free trade. The employee liberality grants the union citizens within the EEC of entry rights and unlimited rights to residence in connection with the free choice of a job. The freedom of emigration or settlement offers the possibility their enterprise location to the independent ones freely of selecting after optimal location factors. The freedom of service protects both service provider and service receivers with transnational demand. The freedom of capital transactions makes the transnational transaction possible of money and investment securities. The freedom of capital transactions refers to the fulfillment of commitments. The person who can enjoy basic freedoms, is the natural persons and the legal persons of the member states, which are in member states of the European Union created. But the case that the legal persons and the natural persons of the third country can enjoy, exists unusually. If an agreement and a treaty between European Union and the third country about the basic freedoms exist, may be people and company(the legal person) of the third country subject to the enjoyment of basic freedoms.
