국민의 정부 이후 계속적으로 논의되어 왔던 자치경찰제도의 도입에 관한 논의들이 제 16대 노무현 대통령의 참여정부출범 이후 지방분권의 국정과제 로드맹 속에 경찰의 독립 수사권 보장을 전제로 한 지방자치경찰제 도입방안이 계속 논의가 되었으며， 2004년 1 월 16일 『지방분권특별법』에 도입의무가 명문화되었다. 그리고 학자들간에 폭넓은 공감대가 형성되고 있다고 판단된다 다만， 현행 경찰법상 경찰제도인 국가경찰이 경찰법상의 경찰목적을 달성할 수 있고 정치적 중립을 지킨다는 전제하에 진정한 국민참여에 의한 지방분권화에 동참하기 위하여 국민참여형 생활중심의 자치경찰제도의 도입이 필요한 시기라 하겠다. 본 연구에서는 이러한 논의를 위하여 지방자치법상의 지방자치 개념을 이해하고，자치경찰의 개념을 법적인 논리와 경찰법상에서 충돌되어지고 있는 부분을 고찰하고자 하며 이를 근거로 하여 지방경찰의 역할과 지방자치법상의 지방경찰사무의 범위를 연구하고자 한다. 연구의 방볍은 각종학회의 논문집과 선행연구를 검토하였으며，현재 논의되고 있는 정부의 자치경찰제(안)와국회，그리고 경찰 내부에서의 그간의 과정을 고찰하여 현행법률상의 문제점을 밝혀 내는 것이며 연구의 목적은 국민참여를 기본으로 하는 지방화 시대를 열어갈 수 있는 지방자치경찰 제도가 하루 빨리 도입되고 정착될 수 있는 방안들을 제시하고자 한다.
Abstract
The issue in regards to the introduction of the self-governing police policy, which has been continuously discussed since the establishment of the people's government and the participatory government system that has been implemented by President Roh, (16th administration) under the road-map of the state affairs of power decentralization, the inducement plan for police policy in the local government under the premise of the policeman's independent search right security has been constantly debated. Also, the duty of implementing the special law of the power decentralization became generalized in January 16, 2004. Moreover, this infers the fact that a wide common belief among scholars has been created. The existing police regulations allow the national policemen to achieve its objective for its institution. However, in order to enhance the citizen's participation at the local level under the premise of maintaining the political neutrality, the time has come to implement the self-governing police policy focusing on people's participation. In order to study these issues, this study will introduce the concept of regulations in the local government; examine the legalistic concept of self-governing police system and its conflicts in the regulation; and with these evidences, research the function of the local police and scope of local police administration of local government laws. The methods of the research are review the collections of thesis from various institutes and previous researches, consider the national government's proposal on self-governing police and national assembly as well as the inter process of police; therefore reveal the problem of the current legal system, and suggest an alternative plans that would firm the self-governing police. The purpose of this research IS to propose a way to implement and permanently settle the self-governing local police policy that opens the era of localization to enhance people's participation.
