Abstract

The substantial guarantee of the right to vote for the socially disadvantaged holds significant constitutional value as it upholds the principles of universal suffrage, which mandates that “everyone must participate in elections,” and equal suffrage, which requires “the guarantee of participation opportunities and values without unjust discrimination in the electoral sphere.” Furthermore, it plays a crucial role in ensuring that representatives of the people pay closer attention to the voices of the socially vulnerable, who are often marginalized in national decision-making processes. This paper examines the legal norms and institutional frameworks within German law that pertain to the guarantee of suffrage for the socially disadvantaged. Through this analysis, it identifies shortcomings in the current electoral system that fail to adequately guarantee the right to vote for the socially disadvantaged and derives the following comparative legal implications: First, it is necessary to introduce new provisions in electoral law to facilitate access to election information for mentally vulnerable individuals, such as those with developmental disabilities. Additionally, access to election information must be strengthened for the visually and hearing impaired. Second, the scope of individuals eligible to vote at their residence under the electoral system should be expanded to include those with mental disabilities, and the vote assistance system should be applied to the vote-at-abode procedure. Third, when implementing the voting assistance system, mental reasons should be included in the criteria for eligibility to use the system. Moreover, provisions should be established to exclude voting assistants if there is a risk of undue influence on the voter. Fourth, electoral law should establish not only voting procedures for the visually impaired but also tailored voting procedures for individuals with various disabilities, accommodating the type and degree of their disabilities. Fifth, the electoral system should guarantee comprehensive suffrage rights without restricting the right to vote for individuals with severe mental disabilities. In this regard, systemic improvements must be pursued to ensure the substantive guarantee of their right to vote throughout the electoral process.
