정신적 장애인의 선거권 보장은 국가가 구체적인 제도나 방안 등을 마련함과 동시에 정신적 장애가 갖는 특성에 맞는 개별적인 원조로 보장될 수 있다. 이를 위해서는 정신적 장애인에 대한 사회의 전반적인 인식변화와 더불어, 정신적 장애인의 기능과 특성에 맞는 지원 서비스가 제공될 때 보편적인 시민으로서 주권을 행사할 수 있게 될 것이다. 그러나 오늘날 우리 사회는 정신적 장애인의 기본적인 권리 행사에 대하여 부작위 즉 소극적인 태도로 일관하고 있으며, 이는 정신적 장애인이 자신들에게 부여된 기본권을 행사할 수 있도록 하는 ‘구체적인 수단 및 사회적 지원이 없는 것과 같은 것’이다. 이는 비장애인 대비 혹은 다른 유형 장애인 대비 정신적 장애인에 대한 명백한 ‘차별’이라 규정할 수 있을 것이다. 정신적 장애인이 기본적인 권리로서 선거권의 행사를 보장받기 위해서는 ‘합리적인 배려’와 ‘적극적인 조치’를 통해, 정신적 장애인이 보편적인 한 명의 인간으로서 권리를 행사할 수 있는 환경이 제공되어야 할 것이다.
Abstract
Voting right is one of the general right given to everyone whether he/she has or has not disability, and it should not be transferred to anyone. However, voting right of the mentally disabled people has not been fully protected by the law in our society. They are only mentioned in the law without any proper procedures to guide. The disabled people should be able to live in equal terms with the others who has no disabilities. They should not be trampled upon human rights. The government should find ways to protect their right and should distribute proper services according to their needs and the level of function. Everyone has to be equally protected by the law in practicing their given right in their own nation. People should not be treated differently or unfairly in accordance with their disabilities or the types of their disability.
