Abstract
In accordance with the economic growth, the scale of public interest corporations has increased as well as the number of them. The tax law provides various tax benefits in consideration of the social role and contribution of public interest corporations. However, despite the positive function of public interest corporations, problems such as the use of donors pursuit of private interests or the failure to faithfully carry out public services have been revealed. due to the lack of appropriate follow-up management regulations. In addition, as the legislative direction to improve these problems has been excessively revised based on the case of the corporate foundation, the post-management system of contributed property has become complicated and difficult, and contrary to legislative intentions, problems caused by overlapping regulations are emerging. Also, there is a problem that excessive regulation centered on donors weakens donors good will to donate. Based on this background, this study aims to evaluate the current regulations and systems related to public interest corporations and the follow-up management system, and intends to find desirable ways to improve the follow-up system to revitalize public interest corporations. Compared to other countries, the verification of public interest corporations that receive tax benefits is not properly conducted, which is why post-management must be strengthened. Of course, it is also true that in the past, companies used public interest corporations for illegal donations or private gain, and that the post-management system for public interest corporations is complicated and regulations are strengthened. Japan, which has a post-management system for public interest corporations like ours, strengthened the verification of public interest and relaxed the taxation system like the UK through the reform of the public interest corporation system in 2008, so it may be possible to strengthen the verification of public interest corporations and simplify the post-management system for donated assets like the US. In addition, the complex post-management system for donated assets is causing excessive tax burdens on public interest corporations. This excessive tax burden may prevent public interest corporations from smoothly carrying out their intended business or even threaten the very existence of public interest corporations. In the case of the United States, there is a need to unify our public interest corporation tax system into a additional tax, as violations of the post-management obligations of public interest corporations are taxed as additional tax, and repeated violations are subject to heavy taxation. Excessive tax burdens on public interest corporations can affect good-faith donors, so improvement is necessary.
