Abstract

Although the Fifth Republic of France is not a federal state, it adopts a bicameral system and has a upper house called "Sénat(Senate)" in addition to the National Assembly, which is the lower house. The French is weaker than the National Assembly in terms of legislative power and executive check power, but still has considerable power. However, in the history of the 5th French Republic for more than 65 years, the left has only taken the majority seat of the Senate for three years, showing a relatively continuous conservative trend compared to the National Assembly, which is elected by direct elections by the French people. This seems to be due, above all, to the way senators are elected. According to Article 24 of the Constitution of the Fifth Republic of France, the French Senate must represent local administrative bodies and senators must be elected by indirect election, and the composition of the electorate called ‘Grand Electors’ and the voting method are advantageous for rural areas with strong conservative tendencies. In compliance with the spirit of the Constitution, most of the large electors are composed of members of local assemblies(constituted according to Commune level, Département level, and Région level), of which delegates representing Communes account for an overwhelming proportion of the entire presidential delegation, and small Communes with a small population are designed to be overrepresented in the allocation of the number of delegates. Moreover, the Département, a constituency for senatorial elections, is assigned the number of senators to be elected according to the size of the population, and the proportional representation system is only applied in the case of the large number of Départements, and the majority representation system is applied in the rest. This method of senatorial election increases the influence of less populated rural areas and further provides a favorable horizon for conservative political forces. Although several revisions have been made to more equitably adjust the number of delegates between communes and expand the scope of the proportional representation system, it is still insufficient to clear controversy over democratic representation in the French Senate.
