Abstract
It is not surprising anymore that intellectual property rights are leading players in international business transactions, but still embarrassing that they create complex multinational intellectual property disputes. Consequently, the most critical issues in multinational intellectual property litigations are to decide which country has jurisdiction over the disputes and which law governs them. This study deals with the European Union(EU) principles and cases on international litigations for intellectual property disputes. The EU has more sophisticated version of legal theories and practices on multinational intellectual property disputes than any other country. It focuses on Brussels I Regulation that contains special jurisdictional rules on preliminary issues such as the validity of intellectual property right itself and matters arising from license contracts as well as other jurisdictional principles in general. The Korean principles on international jurisdiction are based primarily on the Korean Private International Law Article 2 amended in 2001 and secondarily on the relevant rules that the Korean Civil Procedure Code provides. The Court has jurisdiction over the case when it finds the subject matter or the parties of the case has substantial relations with Korea. At this time, the court must follow reasonable principles that correspond with the ideal of the allocation of international jurisdiction. More specifically, the court must consider the unique characteristics of international jurisdiction and refer to the Korean Civil Procedure Code complying with the Korean Private International Law Article 2, Clause 2. It’s hard to say that which legal method is definitely ideal for deciding international jurisdiction as a whole because each country has a different legacy of both law and history. As the Korea-EU FTA makes legal, economic and cultural transactions grow between the two, it is strongly recommended to have in-depth understanding of the EU principles on international jurisdiction over intellectual property matters preparing against probable disputes in advance. In this respect, this study provides a meaningful opportunity to look through the EU framework of international jurisdiction in multinational intellectual property litigations and reaffirms the significance of it.
