한·중·일 무역구제 담당조직 및 법규의 발전과정에 대한 비교분석

Abstract

Currently, the governmental agency in charge of trade remedy matters in China is the MOFCOM. By concentrating responsibilities and power to the Ministry in the field of trade remedy, China has established an organizational foundation, based upon which effective trade remedy policies will be pursued in connection with goals of the domestic industrial policies. Japan has maintained its unique tradition of the multi-ministerial cooperation system in dealing with trade remedy issues. Based on the premise of equality of power among ministries concerned, the Japanese government has been taking stable and balanced trade remedy policies. The trade remedy system in Korea started with one-ministry concentration style. After exploring the multi-ministerial cooperation style and the hi-ministerial cooperation style, the Korean system returned to the concentration style after the establishment, and with expansion of the role, of the Korea Trade Commission. Mutual understandings of trade remedy systems among the three countries are important given the recent trend of regional trade integration in Northeast Asia. Based on these enhanced understandings, integration and harmonization of trade remedy systems in the region may be explored.
