Abstract

This paper studied the historical origin of the concept of non-obviousness under US patent law. The federal court decisions of a certain period of time(1790-1899) were thoroughly investigated to discover precedents related to the concept of non-obviousness, and qualitative and quantitative analysis were conducted in parallel. As a result, it was revealed that the historical origins of this concept were as follows. First, in terms of concept in a narrow sense, Jefferson’s amendment in 1791 can be said to be its origin, and it was revealed more specifically through the witness’s statement (Earle, 1825) in court, and it can be evaluated that a lawyer (Willard Phillips, 1837) completed it. Second, from the perspective of decisions, the lower court precedent(Hovey, 1846) that recognized this concept as an auxiliary criterion can be seen as its origin, but the first Supreme Court precedent(Pearce, 1880), which recognized this concept as a key criterion, can be evaluated as the practical origin in that it contributed decisively to the establishment of the concept as legal principle. Third, according to statistical analysis, the revolutionary period when this concept was firmly established in courts was in the 1880s, and the number of decisions applying it increased sharply in the 1890s. One of the causes is pressure on the reform of the patent system due to the deepening patent abuse phenomenon for agricultural equipment, which has become serious since the 1870s. In response to this phenomenon called patent sharks, farmers’ organizations systematically supported patent invalidation lawsuits, and the Supreme Court decisions related with non-obviousness doctrine(Atlantic Works, 1883) mentioned this issue. Meanwhile, the background of the emergence of the concept of non-obviousness in the United States is the social antipathy to monopoly and the culture that values inventors. Until now, the Hotchkiss decision(1851) has been known as a historical origin of non-obviousness rule, but this paper is meaningful in that it has been found that Pearce decision(1880) should replace its position. It is also meaningful in that statistical analysis objectively revealed that the 1880s was the period of settlement of the U.S. non-obviousness rule.
