북한의 노동력 배분제도

초록

북한의 우리식 사회주의 계획경제질서에 따른 생산수단의 국유 및 집단소유 원칙과 노동력 배분(allocation) 및 소득 분배(distribution)는 ‘사회주의 헌법’에서 정하는 모든 공민의 노동의무, 국가의 완전고용 실현, 근로자의 직업선택권 보장에 기초한다고 할 수 있다. 이 중 노동력 배분은 근로자에 대한 권리적 개념으로 확립되었다는 점에서 자본주의 시장경제질서에 따른 사용자의 재산권과 채용의 자유, 근로자의 근로권 및 직업의 자유 등과 밀접하게 연관되어 있다. 그러나 그 권리적 접근방식에서는 상당한 차이가 있다. 북한 주민의 노동권과 관련한 법제도적인 쟁점을 다루기 위해서는 북한식 사회주의 계획경제질서에 따른 노동력 배분제도에 대한 이해가 선행되어야 한다. 북한의 사회주의 계획경제질서에 따른 모든 공민의 노동의 의무, 국가의 완전고용 실현, 근로자의 직업선택권 보장 등에 기초한 노동력 배분제도는 자본주의 시장경제질서에 따른 소유권(재산권), 사용자의 채용의 자유, 근로자의 근로권 및 직업의 자유와 밀접하게 연관되지만, 조화되지는 않는다. 노동력 사용과 관련한 이들 부조화와 관련하여 발생하는 쟁점을 해소하기 위한 노력으로 흔히 노동력 도입국 및 사용자, 외국인투자기업의 법적, 도덕적 책임과 역할이 강조되기도 한다. 그러나 이러한 자본주의 시장경제식 접근방식에 기초한 대응방식은 대외경제부문의 노동조건 등에서는 일정부분 기능할 수 있으나, 노동력 배분제도에서는 기능하기 어려운 구조일 수 있다. 이 연구는 2012년 김정은 집권 이후 가속화된 북한의 우리식 사회주의 경제개혁의 변화상에도 불구하고 노동력 배분 및 보장제도가 대내ㆍ외의 모든 경제부문에 유지됨으로써 강제노동 등 노동권적 쟁점을 발생시키는 원인이 되고 있다는 점에 주목한다. 그리고 북한의 노동력 배분 및 보장제도를 경제부문별로 구분하고, 북한의 노동권적 담론을 자본주의 시장경제질서에 따른 노동법적 관점에서 비교ㆍ분석한다.

Abstract

Under North Korea’s socialist planned economic system, the principle of state-owned and collective ownership of the means of production, as well as the allocation of labor and income distribution, are based on the labor obligations of all citizens, the realization of full employment by the state, and the guarantee of workers’ right to choose their jobs as stipulated in the ‘Socialist Constitution’. In a capitalist market economy, labor force allocation is closely related to employers’ property rights and freedom of employment, workers’ right to work and occupational freedom, being established as a concept of rights for workers. However, there are significant differences in North Korea’s approach to rights. In order to deal with legal and institutional issues related to the labor rights of North Koreans, it is necessary to understand the labor distribution system according to the North Korean-style socialist planned economic system. Under the socialist planned economic system, the labor force distribution is based on the duty of all citizens to work, the realization of full employment by the state, and the guarantee of workers’ right to choose a job. These would seem to be closely related with the capitalist market economy system’s concepts of ownership (property), the employer’s right to hire, and the workers’ right to work and freedom to work. However, in actuality they are not harmonized. In an effort to resolve issues related to these inconsistencies, the legal and moral responsibilities and roles of manpower importers, employers, and foreign-invested companies are often emphasized. However, the response method based on a capitalist market-economy perspective may function to some extent in the working conditions of the external economic sector, but may be difficult to function in the labor force distribution system. This study shows that, despite changes in North Korea’s socialist economic system that have accelerated since Kim Jong-un came to power in 2012, the labor force allocation and guarantee system is still maintained in all economic sectors both internally and externally, thereby leading to labor rights issues such as forced labor. In addition, in this study, North Korea’s labor force distribution and guarantee system is divided by economic sector, and North Korea’s labor rights discourse is compared and analyzed from the perspective of labor law as understood in a market economy system.
