Abstract
Artificial Intelligence(AI)’s technical complexity, autonomy, and ability to evolve based on big data can cause various problems in relation to patent infringement. Even AI that did not infringe patent claims at the time of development can subsequently infringe on others’ patents as it evolves through learning from external data and internal evolution. In this case, various issues are raised such as whether it actually falls within the scope of infringement, how to prove it, and how to identify who is responsible for it. Because AI systems have little visibility into how they work in practice, claimants will have difficulty proving the fact of infringement. In addition, the responsibility for patent infringement due to evolution is likely to go to the user or developer of AI. However, if such evolution was completely unpredictable, and if various parties were involved in development, machine learning, supplying data, and providing server until AI was implemented, there may be limitations in discussing the responsibility based on current rules. This paper analyzes the possibility of patent infringement by AI, reviews various problems of patent law that may arise from it, and discusses solutions to it.
