이 연구는 우리나라의 독특한 지방 공유재(local common)의 하나인 곽전(미역바위)의 관리에 있어서 정부실패를 최근 사회과학계의 주목을 받고 있는 분석적 기술법을 통해 분석하였다. 구체적 사례로는 5.16이후 탄생한 군사정권이 1963년에 수산업법의 개정을 통해 조선시대 이후 관습에 기초한 사유화 방식으로 관리되어 오던 곽전을 어촌계를 중심으로 한 공동체 관리방식으로 전환한 사건을 말한다. 개정된 수산업법 하에서는 곽전에서 발생한 수익의 사유화가 인정되지 않고 어촌계가 그 이익을 고르게 분배하도록 규정함으로써 곽전의 소유권을 둘러싸고 기존의 곽전주와 비곽전주들간에 첨예한 분쟁이 발생하였고 미역생산도 급격하게 감소하였다. 정부의 정책변경은 원래 상태에 비해 볼 때 편익보다는 손실을 크게 발생시킴으로써 전형적인 정부실패 사례가 되었다. 기존의 연구들을 정부의 이러한 정책변경을 탁상행정의 전형이라고 비판하였으나, 이 연구는 그 정책변경이 당시 정책결정에 영향을 미칠 수 있는 이해당사자들간의 정치적 역학관계의 산물로서 생겨난 현상으로서 정부가 충분한 정보를 보유하고 신중하게 정책결정을 했더라도 생겨날 수밖에 없었던 구조적인 문제라고 지적하였다. 이 연구는 단순히 탁상행정의 사례로 넘길 수 있었던 정부의 정책실패 사례를 구조적 측면에서 분석함으로써 그 원인을 보다 정확하게 이해하는데 일조했다고 할 수 있을 것이다.
Abstract
This study addresses a government failure in the governance of local commons in South Korea. The particular commons we are concerned with is seaweed breeding rocks or called as Kwackjun in Korean, Specifically, this study focuses on a historical event occurred in 1963, where the interim government established after the 5.16 military coup d'état, changed the governance mode of local commons through legal amendment from private ownership to the management by fishing village communities. Because of this legal change, severe conflicts had occurred over the property rights of the rocks between the owners of seaweed rocks and residents of fishing villages. In addition, opportunistic behaviors had become more prevalent in the governance of the rocks. As a result, the production of brown seaweeds had decreased substantially and became never be the same as before. The legal change, therefore, would be a prime example of government failure. The existing studies have suggested the desktop administration of the government as the major cause of the government failure. This study, however, explores in detail a political interplay over the legal change among various interest groups and identifies the mechanism underlying such interplay using a special research methodology called analytical narratives. The significance of this study is that it provides a more realistic explanation of causes of the government failure occurred in the governance of local commons.
