중국유전자기술법제의 현황과 문제점

Abstract

In recent years, technique as the core of biotechnology has gained considerable development in China.However, bio-technological advances are bound to cause great havoc on the existing legal system, which lead to reconfiguration and optimization of the legal system. The first part of this article describes the development of transgenic technology in China and analyzes the impact of biological technology on the traditional legal system. The second part discusses an overview of the transgenic legal system, and mainly introduces the rules and regulations on transgenic technology.Based on the challenge of transgenic technology to the traditional legal system, the third part analyzes and researches the problems of China's transgenic current legal system. To be specific, the challeng of the status of human being legal subjects, the security of transgenic technique, cooperation between countries, publicity and identification and accountability of GMO information, and so on. In addition, the final conclusion of the article talks about a common problem of China's legal construction, which is failure to abide by strict law enforcement. Therefore, concerned the current sitiation of China's transgenic legal system, the more important is the implementation and enforcement of existing laws and regulations, rather than further readjustment and improvement.
