이 논문은 “우리(들) 대한국민”이 두 가지 곤경에 직면해 있다는 문제의식에서 출발한다. 첫째, 루소에 의해서 제기된 인민과 헌법 사이의 역설적 관계다. 헌법의 저자로서 인민이 헌법에 의해서만 그 정체성을 부여받게 된다면 헌법은 민주적으로 정당화 될 수 없는가? 둘째, “우리(들) 대한국민”의 정체성을 둘러싼 논쟁이다. 헌법제정기에는 논란이 되지 않았던 건국과 제헌의 시점이 왜 새삼 문제가 되는가? 이 논문은 외부적 권위에 의존하지 않고 인민과 헌법의 관계가 정립되는 방식을 사회계약론의 전통 속에서 발견할 수 있다고 주장하면서, 인민과 헌법의 관계 속에서 “우리(들) 대한국민”의 정치사상을 규명하는 것을 목적으로 한다. 이를 위해, 이 논문은 자연과 대표라는 개념을 둘러싼 사회계약론 담론을 재해석하면서 시에예스적 인민과 홉스적 인민이라는 상이한 ‘우리, 인민’의 개념을 제시한다. “우리(들) 대한국민”이 시에예스적 인민에서 홉스적 인민으로 이행하고 있다는 해석을 통해 ‘우리, 인민’이 직면한 두 곤경에 대한 해법을 제시함으로써 대한민국 건국과 제헌을 둘러싼 논쟁의 장에 기여하는데에 이 논문의 의의가 있다.
Abstract
“We, the people of Korea” are in a predicament. It concerns the paradoxical relationship which Rousseau raised between the people and the constitution. If the people are given their identity as the author of the constitution only by the constitution itself, the founding cannot be democratically legitimate. Furthermore, in the founding of the Republic of Korea the identity of “We, the people of Korea” is in dispute. Recognizing that these problems are theoretical rather than historical, this paper examines the puzzles associated with the paradoxical relationship between the people and the constitution. The concepts of nature and representation are analyzed in the discourse of social contract theory, and two different concepts are presented of ‘we, the people’ as the author of the constitution. It is argued that the controversy over the founding moment was triggered by a change in the concept of ‘we, the people’ from a Sieyesian understanding of the people to a Hobbesian one.
