1814년 아파칭간 헌법에 나타나는 새로운 정치적 관념

초록

1814년 10월 22일 오늘날 멕시코 미초아칸주의 아파칭간에서 「멕시코 아메리카의 자유를 위한 헌법」, 일명 ‘아파칭간 헌법’이 공포되었다. 비록 전쟁 중에 공포되어 많은 제약을 지닌 헌법이었으나, 독립이라는 급진적인 변화 속에서 구상한 새로운 정치공동체의 모습이 처음으로 헌법이라는 형식에 담겼다. 본 논문에서는 아파칭간 헌법에서 제시된 국민, 인민, 주권, 시민, 대의제 등의 정치적, 법률적 개념을 분석한다. 한편에서는 스페인어권 아메리카에서 중층적 의미로 사용되어 온 나시온과 푸에블로라는 용어가 근대적 의미의 주권 개념과 결합하여 새로운 정치적 개념으로 성립되고, 다른 한편에서는 적극적 정치적 의지를 지닌 시민과 그 의지를 대변하는 의회 구성을 법률적으로 규정함으로써 독립국가의 틀을 마련하였다. 이를 통해 아파칭간 헌법의 작성자였던 독립전쟁 전반기 반란군이 모색했던 새로운 정치공동체의 모습을 탐색한다.

Abstract

“The Constitutional Decree for the Liberty of Mexican America”, the so-called ‘Constitution of Apatzingán’ was promulgated on October 22, 1814 in Apatzingán, the region of the Mexican state of Michoacán. Although it had a limited effect as it was promulgated during the war, the new political community envisioned in the radical change of independence was first included in the form of the constitution. This paper analyzes the political and legal ideas of nation, people, sovereignty, citizens, representative system etc. presented in the Constitution of Apatzingán. In one part, the term “nation” and “people”, which have been used in a superimposed meaning in Hispanic America, are combined with the concept of sovereignty in the modern sense and formed into a new political concept. In the other part, the framework for an independent nation was established by constitutionally stipulating the presence of citizens with active political will and the formation of a congress whose objective is to represent their will. Through this, it explores the new political community sought by the leaders of the insurgency in the first half of the War of Independence, who were the authors of the Constitution of Apatzingán.
