보세판매장은 국제관광수지 개선, 고용창출, 외국인 관광객 유치로 관광산업 활성화에 기여하는 등 국가경제 발전에 기여도가 높음에도 불구하고, 규제로 업계 발전을 저해하고 있으므로, ① 규제 완화를 통해 보세판매장의 발전과 나아가 국가경쟁력 강화에 기여할 수 있도록 위해서 보세판매장의 경쟁력이 강화되도록 자율환율관리 제도 도입, 판매 방법 확대하고, ② 보세판매장 자율법규준수 점검 시스템을 도입하여, 그 평가결과에 따라 자율규제할 수 있도록 하여 형평성을 확보하며, ③ 상위 법령에서 위임하지 않은 시내 보세판매장 신규특허와 특허갱신 조건 중에 외국인 구매비율과 외국인 입국자수로 제한하는 규정은 위임규정을 마련하여 객관성을 확보하도록 개선하여야 할 것이다.
Abstract
Duty free shop, despite their high contribution to the national economic development, contribute to the revitalization of the tourism industry by improving the international tourism balance, creating jobs, and attracting foreign tourists, are hampering industry development through regulations. Therefore, ① In order to contribute to the development of duty free shop through the deregulation and to strengthen the national competitiveness, the autonomous exchange rate management system should be introduced and sales methods are strengthened to enhance the competitiveness of bonded stores. ② Implement the inspection system of the duty free shop voluntary law compliance to ensure equity by allowing self-regulation according to the evaluation result. ③ Among the new patents and the conditions for renewal of patents in the downtown duty free shop, which are not mandated by the higher statutes, the restrictions on the purchase rate of foreigners and the number of foreigners will need to be improved to ensure objectivity.
