Abstract

· Research topics: Expansion of the field of application of DRB as a pre-dispute resolution system and a application method are explored. · Research background: DRB, a pre-dispute resolution system, needs to be actively introduced and utilized in Korea. Its application field needs to be expanded not only in the construction field, but also in various fields such as subcontract disputes and disputes in the distribution field. · Differences from prior research: The existing discussion of DRB has been limited to the construction field. This paper focuses on expanding the field of application and suggesting specific application methods such as its operation method and legislation. · Research method: It focuses on literature research. We present specific application plans for institutionalization, such as the characteristics of DRB, usefulness, field of application, and the issue of the law based on the establishment of the DRB and the problem of securing a pool of members to utilize the DRB in Korea. In this respect, it differs from prior research. · Research results: As a pre-dispute resolution system, the usefulness of DRB is maximized and its operation method is presented. And, as a specific application method, guidelines through laws and regulations for its establishment were presented, and a plan to secure a pool of experts for appointment of DRB members was presented. · Contribution points and expected effects: If DRB is introduced and utilized in various fields, it will be possible to supplement the problems of the ADR system and suggest new options for dispute resolution.
