망 중립성에 대한 경쟁법적 시각- 미국에서의 논의를 중심으로 -

본고에서는 인터넷 산업의 성숙화에 따른 규제표준의 하나인 망 중립성 논의를 미국의 경우와한국의 경우로 나누어 살펴본다. 미국에서는 인터넷 개방성이라는 공공성을 목표로 이에 필요한요건으로서 망 중립성을 구상하고 있어서 규제기관의 관할권이 주요한 이슈가 되고 있지만, 한국에서는 공공성에 대한 논의보다는 망의 희소성에 따른 망 관리비용 부담문제에 초점을 두고 있는것이 사실이다. 인터넷 산업의 특성상 망 제공사업자에게만 부담시켜서는 결국 산업자체의 위기를 초래할 수 있는 점은 주지의 사실이며, 따라서 망 비용을 부담하는 주체는 소비자를 포함한모든 망 이용자가 되어야 할 것이다. 또한 이와 관련하여 경쟁법상의 여러 가지 문제들이 발생할수 있지만, 인터넷 산업은 그 성질상 사업자가 유기적으로 결합되어 있으며, 그 기능 및 역할을분리하기 쉽지 않기 때문에 특히 관련시장획정 문제에 있어서 곤란을 겪게 되는 것이 사실이다. 인터넷 시장분석을 단면적으로 하게 되면, 멀티호밍과 같은 시장점유율은 높으나 시장지배력이없는 외부효과에 대한 적절한 반영이 있을 수 없게 되어 긍정오류를 범할 우려가 높다. 긍정오류는 인터넷 산업과 같이 혁신이 그 근간을 이루는 산업에 있어서는 치명적인 결과를 초래할 가능성이 높음에 주의하여야 한다. 이와 관련하여 망 비용부담문제는 주요한 아이디어를 제공한다. 즉, 시장의 단원성(모듈성)을 기반으로 하여 관련시장을 획정할 수 있는 기준을 마련한다. 시장분석에 있어서 관련 사업자들의 경쟁제한정도에 대한 소명을 제출하도록 함으로써 다면적 플랫폼을 갖고 있는 인터넷 산업에 대한 경쟁분석의 틀(관련시장획정)이 마련될 수 있을 것이며, 2010년미국 수평적 결합 가이드라인의 개정부분을 반영한 시장분석이라고 할 수 있을 것이다.
Abstract
Internet Industries in Korea have been developed with the support of technology innovation and government policy, and then Korea has the most advanced internet environment in the world. In the United States, Federal Communication Commission issued the order “Preserving The Open Internet” with network neutrality issue. Because of the data traffic explosion nowadays, however the network neutrality which is sensitive issue that require time, is under debate. In Korea, the focus on the network neutrality issues is who takes the burden of network maintenance cost. From these circumstances, regulative and antitrust issues are considered in this article. Internet industries are connected with each other systematically, and it is difficult to enforce the antitrust law and policy in the multi-platform. Antitrust and Telecommunication regulator is necessary to set forth the application based on ecosystem, as well as traditional analysis.
