교육의 책무성 한계에 관한 법적 고찰

교육당사자들은 교육의 책무성을 자신의 처한 상황과 과정 및 결과와는 무관하게 이루어지는 것으로 인식하는 경향이 높으며, 또한 교육의 책무성을 기피비판하고 냉소적으로 반응하는 ‘평가증후군’을 지니고 있다. 이는 교육조직이 비가시적질적 특성이 농후한 조직, 다양한 구성원과 조직 요소들이 상호작용하는 역동적 조직, 전문적도덕적 조직이라는 특수성을 신중히 고려하지 못한 한계점에서 기인한 것으로 본다. 본 논문은 법학 이론과 판례를 기초로 하여 교육의 책무성 한계에 대한 논리적 증거를 제시하고 이를 정당화하는데 있다. 이 논문에서 제시하는 교육의 책무성 한계에 대한 법적 논증 사례는 교육전문가로서의 전문적 재량권을 보장하는 ‘재량행위’, 교육당사자의 전문적 판단과 결정 권한을 존중하는 ‘판단여지’, 책무 내용을 규정하는 법규 용어에 있어서 다의성선택성을 특징으로 하는 불확정개념 등에 해당된다. 이것들은 장기간의 시간과 노력을 통해 구체적인 사실과 상황 및 맥락을 고려하여 총체적으로 이해해석평가되어야 한다는 특징을 갖는다.
Abstract
The purpose of this article is to demonstrate on the limitations of educational accountability in terms of legal theory and cases. In present, educational accountability can be characterized as “external, summative, norm-oriented, objective, quantitative, monetary incentive”. These bring about a type of "evaluation symptom", which is an evasive, critical and cynical responses of educational accountability. In order to solve these problems, educational accountability has to point to analyze the characteristics, contexts, and practices of educational organization. And educational accountability need to give an careful consideration of legal theories and cases, such as discretionary disposition, an indefinite definition, and blank of judgment, and the like.
