공중협박자금 조달금지법의 체계론적 고찰

우리나라가 2004년 2월 17일 서명, 비준한 「테러자금 조달의 억제를 위한 국제협약」을 이행하기 위한 법적 장치가 요구됨에 따라 2008년 12월 22일 테러자금조달행위를 금지하기 위한 「공중 등 협박목적을 위한 자금조달행위의 금지에 관한 법률」이 제정 되어 시행되고 있다. 이 법은 제정초기 「테러자금조달금지법」의 명칭으로 법률안이 국회에 제출되었으나 ‘테러’에 관한 개념정의의 모호성과 인권침해 우려 등으로 많은 논란 끝에 ‘테러자금’이라는 용어대신 ‘공중 등 협박자금(공중협박자금)’이라는 용어를 사용하여 본 법의 명칭으로 제정되게 되었다. 그러나 본 법률은 제정 당시 입법 목적의 정당성 논란이 있었음에도 불구하고 최근에는 테러자금에 대한 금융제재 강화 필요성을 국제자금세탁방지기구(FATF)등이 지적함에 따라 법률을 더욱 강화하는 방향으로 개정 방안을 검토하고 있어 이로 인한 논란이 예상되고 있다. 따라서 본고에서는 테러자금억제를 위한 효율적 수단이라는 인식하에 법적장치로서 시행되고 있는 동법률내용의 정당성과 문제점 및 보완방안에 대해 재검토하고자 하였다. 국민의 기본권 보호라는 측면에서 우려되고 논란이 되고 있기도 하나 테러활동의 배후에 흐르면서 자양분의 역할을 하고 있는 테러자금의 차단은 더 이상 양보할 수 없는 사항이라 할 수 있기 때문에 오히려 동법률은 더욱 보완되고 강화될 필요가 있다고 생각된다.
