본 논문은 ‘조기수확프로그램(Early Harvest Programme, 이하 EHP)'을 중심으로 중국의 FTA 추진 전략의 특징을 분석함으로써 협상 개시 직전에 임박해있는 한-중 FTA에 정책적 시사점을 제시하는데 그 목적을 두고 있다. 이를 위해 우선적으로 지금까지 중국의 FTA 추진 현황과 특징을 살펴보았고, EHP를 활용한 FTA의 경우 일반적으로 논의되는 경제적 이익보다는 전략적 차원 - 개발도상국을 상대로 지리적 인접성을 고려하여 지역내 안정을 도모함과 동시에 중국의 ’시장경제지위 인정‘에 대한 보상 차원 등 - 에서 FTA가 이루어지고 있음을 밝히고 있다. 이와 함께 중국 이외에 EHP를 활용한 FTA를 분석하여 중국의 그것과 비교를 시도하였으며, 여타의 무역협정에서도 EHP 활용은 다분히 전략적인 차원에서 이루어지고 있음을 밝히고 있다. 그러나 양자간 무역협정 체결시 EHP 활용은 개발도상국들을 대상으로 이루어지고 있다는 점과 EHP를 통해 궁극적으로 완전한 형태의 FTA 체결을 시도하고 있다는 사실에 근거하여, 본 논문은 WTO 규범에 따른 양자간 특혜무역협정 체결의 국제통상법적 고찰을 시도하였다. 이러한 논의가 필요한 이유는 한-중 FTA 체결시 경쟁 상대국들에게 미치는 영향이 크다는 점을 감안할 때, MFN 위반의 소지가 있는 EHP를 활용한 FTA 협상에 대한 WTO 규범 위반 문제 제기 가능성 및 완전한 형태의 FTA 추진시 심각한 국내 반발 여론 등이 예상되기 때문이다. 최근 중국이 한국과의 FTA에 적극성을 보이면서 한국이 우려하는 민감품목을 제외한 비민감품목을 우선적으로 협상하자는 - 일종의 EHP - 제안을 공식적으로 했다는 점에서 이에 대한 한국측의 법적․정책적 대응 및 정부 및 학계를 포함한 다양한 각도에서의 추가적인 연구가 요구되는 시점이다.
Abstract
The purpose of this article is to provide the policy implications of the Korea-China FTA negotiation, which is about to initiate, based on the analysis of the China's strategy for FTA. Having explored China's FTA policy and features, this article argues that an FTA which applies EHP is driven forward with the strategic purposes - for example, securing a regional stability in the companionship of developing countries in the region as well as compensating for the admission of China's status of the market economy - rather than economic interests. This article also analyses other FTAs which apply EHP but China's and compares them. FTAs which apply EHP have a common feature that FTAs has been promoted with strategic purposes. Based on two other findings (1) bilateral trade agreements which applied EHP have been promoted with developing countries, and (2) countries in these agreements eventually concluded full-fledged FTAs, this paper examines legal aspects of bilateral preferential trade agreements in terms of WTO rules. The reasons for this examination are as follows: first, the Korea-China FTA, if EHP is applied, could become the subject of an legal action by rival countries in terms of its violation of the WTO principle, MFN provision due to the potentially substantial impact of its FTA; and second, the Korea-China FTA could also become the focus of serious public censure if its FTA is concluded in the full-fledged form. Recently China proposed the initiation of FTA negotiation to Korea. China officially emphasises that only non-sensitive items could be given preference in the negotiating table. This means that Korea could exclude sensitive items, and this China's proposal assumes the form of EHP. In this sense, a further study on the Korea-China FTA with a focus on the China's proposal should be conducted for the Korea's FTA negotiation strategy toward China in terms of legal and policy aspects.
