Abstract
The Fifth Gando Communist Party Incident was the largest case among the socialist-affiliated independence movements in the Gando region where the Peace Preservation Law was applied. It is also a symbolic event where the death penalty was sentenced and executed under this law. In the first trial, out of 261 defendants, 245 were found guilty; 140 people were subject to the Peace Preservation Law; three were sentenced to death and executed. Those who received heavy sentences of 5 years or more in prison under the Peace Preservation Law had participated in Korean socialist organizations from March 1927 and had served as cadres in Chinese socialist organizations from 1930. During the initial judicial process of the Fifth Gando Communist Party Incident, there were differences of opinion between the judicial authorities of the Government-General of Korea and the Japanese Consulate General in Gando over the scope of the Peace Preservation Law’s application. However, it appears that the two sides eventually reached an agreement, and the law was applied to the individuals involved in the incident. The prosecutor in the first trial defined the ultimate purpose of the Korean socialists in the Gando region joining the Chinese Communist Party as “Korean revolution”, or the independence of Korea and the realization of communism, and thus argued that the application of the Peace Preservation Law was legitimate. Based on the prosecutor’s claims, the court accepted the defendants’ statements and the Chinese Communist Party’s platform as evidence to establish the logic that “supporting communist revolutions in Eastern colonies = supporting the Korean Revolution” and “activities by Koreans = independence movement.” The individuals involved argued that their joining and activities in the Chinese Communist Party were aimed at advancing the Chinese revolution, and therefore the Peace Preservation Law could not be applied to them. This appears to have been a courtroom strategy intended to avoid application of the law. During the trial, the defendants and their attorneys asserted that the independence movement did not constitute a transformation of the national polity, and that, since Korean socialists in the Gando region had joined the Chinese Communist Party after the Comintern’s December Thesis, the Peace Preservation Law should not apply. The court rejected these arguments. The final judgment explicitly stated that “the original ruling did not apply the Peace Preservation Law to the fact that the defendants were members of the Chinese Communist Party for the purpose of the Chinese Communist Revolution,” making it clear that the judicial disposition of the Fifth Gando Communist Party Incident was the suppression of Korean socialists who were active for the purpose of the Korean Revolution.
