법과 발전학에서는 선진국이 되기 위해서는 기존 선진국의 법과 제도를 단순히 모방하는 것이 아니라 자국 시장의 특수성과 문화가 잘 반영된 법과 제도를 정착해야 한다고 주장한다. 실제 우리나라를 포함한 많은 국가들이 정책 실험주의(Policy Experimentalism)을 통해 이러한 법과 제도를 정착하기 위해 많은 노력을 하고 있다. 문제는 이러한 법과 제도를 정착시키는 과정에서 국가 간의 약속, 즉 국제법을 반드시 준수해야 한다는 점이다. 하지만 최근 우리나라는 중소기업 및 대기업 관련 국제법 위반 소지가 있는 법과 제도를 정착하고자 한다는 비판을 받고 있다. 본고는 우리나라의 중소기업 및 대기업 규제 관련 정책들을 예로 들어 국제법 위반 소지가 있음을 지적한 후, 정책실험주의를 감행함에 있어서 국제법 준수가 반드시 필요함을 역설한다.
Abstract
Law and development studies suggest that country-specific laws and institutions that reflect local environment and culture are prerequisites for becoming an advanced nation. Apparently, many countries including South Korea are making efforts to establish country-specific laws and institutions that fit their local context by policy experimentalist approach. Here, it is important to note that compliance with international law is critical in establishing such laws and regulations. In this sense, South Korea has been criticized for its potential violation of international law in establishing laws and institutions to regulate small and medium or large enterprises. This article examines such criticism in detail and emphasizes the necessity of complying with international law in conducting policy experimentalism.
