본고는 법개발학(Law and development studies)의 최근 발전동향과 쟁점을 분석하고 법개발학의 새로운 이론적 구조를 확립할 필요성에 관해 설명한다. 본고는 또한 법개발학의 발전에 있어서 동아시아 국가들의 경제발전 경험의 관련성과 중요성을 설명하며 법개발학의 방법론을 확립하고 법이 경제개발에 영향을 미치는 구체적인 기전(Mechanism)을 이해하고 분석할 필요에 관하여 설명한다. 본고는 사회적 이슈를 법개발학의 연구범위에 포함시켜야 한다는 견해의 당위에 관해서도 분석하고 법개발학이나 국제개발프로젝트를 특정한 정치경제적 이념의 실현을 위해 활용하는 경향의 문제점에 관해 경고한다.
Abstract
This paper reviews the development of law and development studies in the recent decades, identifies particular issues and problems, and proposes a new structure for the theoretical framework. The paper underscores the significance of the economic development experiences of the East Asian countriesand its relevance to the law and development studies. The paper also emphasizes the importance of establishing methodology for law and development studies and the necessity of analyzing the mechanism by which laws applied to specific economic activities and industrial areas affect economic development. The paper examines views that support the incorporation of “social issues” as well as economic issues in the law and development studies and cautions against the use of law and development studies and development projects as a way to promote certain political ideologies.
