‘지역 대표형 상원’ 연구: 프랑스·미국·독일 사례를 중심으로

지난 10여 년 동안 의회와 관련하여 우리나라의 개헌 논의에서 발견할 수 있는 특징은 두 가지이다. 첫째, 개헌의 공론화와 공감대 형성을 위한 제도적 장치로써 국회에 개헌기구를 만들어 의견 수렴을 하였고, 한결같은 결론으로 양원제를 제안하였다. 둘째, 양원제 도입의 가장 중요한 논거는 지역의 균형발전, 즉 ‘지역 대표형 상원’이었다. 본 연구는 ‘지역 대표형 상원’의 근거를 확인하기 위해 세 가지 차원에서 접근하였다. 첫째, 양원제의 객관적 현황과 추세이다. 본 연구는 단원제와 양원제의 비중은 6:4 정도이며, 1960-80년대에 양원제 퇴조 현상이 나타났으나, 최근에 오히려 그 격차가 감소하고 있다는 사실을 확인하였다. 둘째, ‘지역 대표형 상원’을 채택하고 있는 프랑스·미국·독일 사례의 함의와 시사점이다. 세 나라의 양원제가 성공적으로 정착할 수 있었던 원인을 하원과는 다른 상원의 고유한 지역 대표성 역할에서 발견하였다. 끝으로, 지방분권과 균형발전, 궁극적으로는 통일 친화적 국가의 모색을 위해서 ‘지역 대표형 상원’을 도입하는 것이 바람직하다는 결론을 얻었다.
Abstract
There are two characteristics that can be found in the discussion of constitutional amendment in the Republic of Korea in relation to the parliament over the past decades. First, as an institutional device for public debate and consensus on constitutional amendment, the National Assembly created a constitutional amendment committees and proposed a bicameral system with a same conclusion. Second, the most important rationale for the introduction of the bicameral system was the balanced development of the region, that is, the regional representative upper chamber. This study approached from three dimensions to confirm the basis of the regional representative upper chamber. First, the objective status and trend of the bicameral system. In this study, the ratio between unicameral and bicameral systems is about 6:4, and although the decline of bicameral systems occurred in the 1960s and 1980s, it was confirmed that the gap has been decreasing recently. Second, as for the implications of the cases of France, the United States, and Germany adopting the regional representative upper chamber, the reason for the successful establishment of the bicameral system in the three countries was found in the unique role of regional representation of the Senate, different from the House of Representatives. Finally, it was concluded that it is desirable to introduce a regional representative upper chamber for decentralization, balanced development, and ultimately, a search for a unification-friendly country.
