우리나라 지방자치단체는 그 의견을 국회의 입법과정에 반영할 수 있는 제도적 장치가 지극히 제한되어 있다. 따라서 국정의 효율적 운영과 국가와 지방자치단체의 새로운 관계정립을 위하여 지방자치단체 또는 그 협의체가 지방자치단체의 이해와 관련된 법률의 제정․개폐, 개별 지방자치단체의 이해에 밀접하게 관계하는 국회의 입법과정에 그 의견을 반영할 수 있는 제도의 도입이 불가피하다. 이러한 인식 하에서 본 연구는 지방자치단체의 국회 입법참여제도 도입방안을 다음과 같이 제안하고자 한다. 첫째, 단기적으로는 국회에 지방자치특별위원회를 두어 지방자치 제도개선과 관련된 개별법을 중립적으로 처리하게 한다. 지방자치대표형 양원제를 도입하기 전 단계로서 지방자치, 지방분권‧재정분권관련 입법과 지방자치법제165조제6항에 따른 지방자치단체 협의체의 법률제‧개정의견을 제출받아 심사할 주체인 특별위원회를 조속히 구성‧운영하도록 제도화해야 한다. 둘째, 국회 지방분권특별위원회 내 가칭 사무배분심의위원회를 설치하여 개별법상 사무의 구분과 배분, 지방자치단체의 재정부담 사항 관련 입법에 대하여 전속적으로 심의하며, 국회내 가칭 입법지원위원회를 설치하여 지방자치단체 또는 그 협의체의 법률안 발의를 실질적으로 지원하는 제도를 도입 시행한다. 셋째, 헌법개정시 지방자치단체를 대표하는 가칭 지방원을 두도록 하는 양원제를 도입한다.
Abstract
Local government in Korea may not be given many occasions to put their opinions into the legislative procedure in National Assembly. In order to boost the effectiveness of governmental management and establish a new relationship between central and local government, it looks like useful for both governments to construct a new cooperative mechanism which guarantees national legislators to take into consideration local government's opinions in the law making process, with regard to the subjects directly relevant to the public interest of local authorities and related to the enactments and revision of various legislatures. In considering what is revealed by far, this paper proposes several ways to promote local government's active participation in the process of law-making at the National Assembly level. Firstly, as a short term solution, it is recommended to set up “Special Committee on Decentralization” in National Assembly to deal with various individual laws connecting with decentralization reforms. Prior to setting in position new representative institution, like the Senate in Germany and the Upper House of National Deputies in France, “Special Committee on Decentralization” has to play a role of judging the acceptance or rejection of the proposition on the decentralization and local finance laws, according to the art.165-6 of the Local Autonomy Law. Secondly, as a sub-committee of the “Special Committee on Decentralization,” “Decentralization Committee on Functional Transfer” contributes solely to examine the laws that concern transferring central tasks to the local government, together with substantial grants affecting to the implementation of functions transferred from central government. Besides, local governments can be helped, when they propose a new law, by setting up a “Supporting Committee on Legislative Procedure” in Parliament. Lastly, as the final stage, we propose the introduction of a new representative chamber of local governments as a bicameral system, when the Constitution is being revised.
