Abstract
(Background and Purpose) In recent years, rural areas in Korea have faced mounting challenges such as unregulated development and the accelerating risk of regional depopulation. These evolving conditions have positioned rural spatial planning at the forefront of policy agendas, prompting various legal and institutional reforms aimed at resolving these issues. Despite such efforts, their practical effectiveness remains limited, as noted by both scholars and practitioners. This study examines the Rural Spatial Restructuring Act and related policy instruments, analyzing their capacity to address rural decline and spatial disarray. Drawing on expert evaluations and policy analysis, the research identifies key limitations and proposes strategies for enhancing practical relevance and policy impact of rural spatial planning frameworks. (Method) This study focuses on legal and institutional frameworks developed in relation to the Rural Spatial Restructuring and Regeneration Support Act, enacted on March 28, 2023. The research centers on a review of rural-related legislation using the National Law Information Center and a detailed analysis of the Act itself. The study proceeds by examining the effectiveness of rural spatial planning in the context of its policy background and implementation processes. Ultimately, through a theoretical review and effectiveness analysis, the study identifies the limitations of the current legal and institutional systems and proposes strategies to enhance their public value and practical application. (Results) To address the common challenges identified through the review of rural spatial planning and related legal frameworks, the following improvement directions and measures for enhancing effectiveness are proposed. First, the Rural Spatial Restructuring Act is the highest law in the rural planning system, and other rural plans must be integrated and comprehensive. Second, the Act must overcome the limitations of the current national territorial planning system by establishing a revised and complementary relationship with the National Land Planning and Utilization Act. Third, the Basic Plan for Rural Spatial Restructuring and Regeneration should function as the only comprehensive mid- to long-term strategic plan at the city and county level, with a ten-year planning horizon. (Conclusions) Following a review of the definition of rural spatial planning and its related legal frameworks, this study examined the interconnections among derivative plans and proposed a strategic direction for ensuring effectiveness, grounded in the Rural Spatial Restructuring Act. In doing so, the study not only addressed the limitations of existing rural spatial planning but also extended its scope beyond the enactment of the Act to consider broader governmental legal and policy structures. By identifying current challenges facing rural areas, the research aims to suggest viable alternatives to improve institutional and policy responses.
