경찰직무와 관련된 국가손해배상청구와 배상액의 규모가 증가하고 있으며 이에 따라 경찰의 무리한 법집행에 대한 비판도 제기되고 있는 실정이다. 그러나 법논리적인 논의와 사후적 차원의 대책만으로는 실무적 차원의 관리방안 마련에는 제한적일 수밖에 없다. 따라서 이 연구는 경찰직무관련 소송에 대한 법이론적 논의가 아닌, 실증적 연구를 통해 소송과 관련된 요인을 규명하고자 하였다. 연구목적을 달성하기 위하여 대법원 종합법률정보 사이트의 판례 검색 서비스를 이용하여 2000년부터 2014년까지 경찰의 직무집행을 대상으로 한 국가배상청구(민사소송) 소송을 검색하여 판결문을 수집하였다. 최종 41개의 판결문이 수집되었으며 판결문의 양적 내용분석을 위해 미리 구성한 가이드라인(코딩용지)을 기준으로 2명의 조사원이 소송과 관련한 경찰직무유형, 원고 및 경찰 관련 내용, 사건의 상황, 소송결과에 대한 양적 내용 분석을 실시하였다. 내용분석의 결과 전체 41개의 사건가운데 소송과 관련한 경찰의 업무 중 가장 많은 것은 수사관련 업무였으며, 원고가 경찰담당사건의 피의자 및 용의자(가족 포함)인 경우가 가장 많은 것으로 나타났다. 소송원인이 된 경찰조치로는 직무상 의무위반 및 권한 불행사가 가장 많았으며 소송결과는 경찰의 손해배상책임을 인정한 경우가 약 70%로 나타났다. 마지막으로 분석결과를 통한 시사점과 연구의 한계를 제시하였다.
Abstract
In Korea, the State compensation lawsuit related to police duty performance is increasing. However, only with law logical discussion and provision of ex post countermeasures is restrictive in preparing measures for affairs related to police duty performance related lawsuit, such as confirming cause, condition, contents and characteristics of lawsuit and preparing working-level management measures. Therefore, this study aims to research by confirming lawsuit relevant factors through empirical study not by conducting theoretical discuss regarding lawsuit relevant police duty performance. In order to analyze the content of court decision, state compensation lawsuit cases(civil suit) subjecting police duty performance from 2000 to 2014 were searched through Supreme court Integrated legal information site case search service, and collected cases. Total 41 court decision were collected, and to conduct qualitative analysis of cases, 2 researchers conducted qualitative content analysis about police duty type, plaintiff and police relevant contents, case situation, and lawsuit results based on pre-constituted guideline (coding form). As for the result, among total 41 court decision, police duty performance which was most relevant to lawsuit was investigation task. And the number of cases which plaintiff was defendant and suspect of police duty case was the largest. As for the cause of lawsuit, duty violation and non-exercise of right of police was the largest, and as for the result, there were 70% of cases which the liability for damages of police was recognized. Based on this study, it is able to confirm current problems of dealing measures, and contribute to preparation of plan in police management.
