경찰관직무집행법상 손실보상 심의 사례연구-서울지방경찰청 손실보상심의를 중심으로-

경찰관직무집행법상의 손실보상제도가 시행된 이래, 전국의 지방경찰청 단위로 이루어져 온 심의는 이제 어느 정도의 축적된 사례연구를 통해 일정한 기준을 마련할 때가 되었다. 손실보상제도가 시행된 지 이미 3년을 넘기고 있으므로 경찰작용으로 인한 피해에 대하여 손실보상이 요구되는 경우를 일정한 유형으로 구분하여 분석하고 일정한 원리와 질서를 찾아가는 작업이 필요하다. 이 연구는 경찰작용으로 인한 피해에 대하여 서울지방경찰청 손실보상심의위원회의 심의결과에 대한 분석을 통하여 이를 유형화하려는 시도이다. 나아가 2018년 1월 손실보상의 범위가 생명·신체에 대해 손실을 입은 경우에도 확대 적용하는 것을 내용으로 하는 「경찰관직무집행법」개정안이 발의된 상황에서 손실보상의 범위가 확연히 늘어날 것으로 예상되는 바, 기존의 손실보상심의위원회의 운영에 따른 제반 법적·제도적 개선 역시 시급하다고 하겠다.
Abstract
It has already been more than three years since the 'Act on the Performance of Duties by Police Officers' imposed a Consideration of Compensation for Loss. So far, It's the time to set a certain standard through some accumulated case studies and the reviews, which has been organized at the level of provincial police agency around the country. Damages should be compensated by a certain rational type and then divided into certain groups to find a consistent principle and order. This study attempts to classify it by analyzing the review results of the compensation committee at the Seoul Metropolitan Police Agency. In addition, the existing "Act on the Performance of Duties by Police Officers" amendment, which applies to cases in which the scope of compensation for losses is being extended and is being made under the urgent necessity of the revision of the Act. The decision of the Loss Compensation Commission shall be made within a reasonable limit on similar cases through the aggregation of follow-up studies. In addition, the loss prevention system shall be established by allowing the government to establish the national security system swiftly.
