약물을 이용한 성폭력범죄의 실태- 주도형 DFSA에 대한 판결문 내용분석 -

초록

약물을 이용한 성폭력범죄(drug-facilitated sexual assault, DFSA)의 심각성에도 불구하고 그 실태에 관한 학문적, 정책적 관심은 미흡한 실정이다. 본 연구에서는 피해자에게 기망 또는 강압 등의 방법으로 약물을 투여한 후 성폭행을 저지르는 주도형 DFSA 사건 1심 판결문 41건(2021년–2023년)의 내용을 분석하였다. 주요 분석 결과는 다음과 같다. 관련 전과가 없는 가해자가 관련 전과가 있는 가해자에 비해 두 배 가량 많았다. 가해자는 지인인 경우가 많았으며, 지인 중에는 직장상사, 고용주 등 피해자에 비해 사회적으로 우월한 지위에 있는 지인의 비율이 가장 높았다. 첫 만남인 경우에는 채팅앱 등을 통한 유흥 목적 만남의 비율이 가장 높았다. 범죄발생장소는 주류판매업소, 숙박업소, 가해자의 주거지 순이었다. 사용된 약물의 종류는 졸피뎀이 가장 많았으며, 메트암페타민(필로폰)이 그 뒤를 이었다. 약물 입수 경로는 가해자 본인의 불면증, 우울증 치료를 위해 공식적으로 처방받은 경우가 가장 많았으며, 온라인, 기타 방법으로 구매한 경우가 그 뒤를 이었다. 법원에 의해 인정된 죄종은 신체접촉 성범죄와 마약류관리법위반죄의 경합범이 가장 많았으며, 카메라 등 이용촬영, 절도 등의 범죄를 함께 저지른 경우도 다수 발견되었다. 분석결과는 약물을 이용한 성폭력범죄가 피해자의 생활양식, 가·피해자의 관계, 사회구조 등 다양한 요인에 의해 발생한다는 사실을 보여준다. DFSA범죄를 예방하기 위한 정책적 제언으로 향정신성의약품의 철저한 관리, 마약류 범죄에 대한 적극적인 단속, 대중교육 등의 방안을 제시하였다.

Abstract

Despite the gravity of drug-facilitated sexual assault (DFSA), limited academic and policy attention has been directed toward its prevalence. This study scrutinized 41 proactive DFSA cases spanning from 2021 to 2023, wherein victims were subjected to drugging through deception or coercion, followed by sexual assault. Key findings revealed noteworthy insights. Firstly, there were twice as many perpetrators without relevant criminal convictions as those with such records. Secondly, perpetrators, often acquaintances, were predominantly socially superior to the victims, such as coworkers or employers. Notably, in first-time encounters, a significant percentage occurred for entertainment purposes through chat apps. Thirdly, the locations of the crimes encompassed liquor stores, accommodations, and the offender's residence. Fourthly, the primary drugs employed were zolpidem, followed by methamphetamine. Fifthly, the sources of these drugs were predominantly official prescriptions by the perpetrator, often for insomnia and depression, followed by online and other channels. Sixthly, the offenses recognized by the court comprised a combination of physical-contact sexual offenses and violations of the Controlled Substances Act. Several cases involved offenses committed in conjunction with other crimes like non-consensual body filming or theft. The analysis underscores the multifaceted nature of drug-facilitated sexual assault crimes, influenced by factors such as the victim's lifestyle, relationship dynamics, and socio-structural elements. Proposed policy recommendations to prevent DFSA crimes include rigorous management of psychotropic drugs, proactive measures against drug-related crimes, and comprehensive public education initiatives.
