가정폭력은 일반 범죄와는 다른 특수성을 지니고 있어 특별한 대응이 필요하다. 본 연구는 가정폭력 현장에서 긴급임시조치 제도의 시행에 영향을 미치는 요인을 분석하고, 해당 제도가 효과적으로 정착되기 위한 방안을 모색하고자 한다. 이를 위해 조사 대상은 현직 경찰관으로 하여, 가정폭력 사건에서 긴급임시조치의 시행 가능성을 설문을 통해 파악하였다. 분석 결과, 가족관계 유지에 대한 인식, 가정폭력 사건에 대한 인식, 제도에 대한 적극적 수용 등 여러 요인이 긴급임시조치의 시행 가능성에 유의미한 영향을 미치는 것으로 나타났다. 특히, 제도의 적극적 수용이 가장 큰 영향을 미치는 변수로 확인되었으며, 가정폭력을 개인적인 문제로 인식할수록, 피해자 인권보다 가족관계 유지를 더 중요하게 인식할수록 긴급임시조치 시행 가능성이 낮아지는 경향이 있었다. 이러한 결과는 가정폭력에 대한 인식 개선과 긴급임시조치 제도의 실효성 강화를 위한 정책적 노력이 필요함을 시사한다.
Abstract
Domestic violence involves physical and psychological harm between family members, distinct from other crimes and necessitating a specific response. This study analyzes factors affecting implementing the emergency interim measures system in domestic violence cases, aiming to establish the system effectively. A survey of current police officers was conducted to assess the feasibility of implementing these measures. The analysis revealed several influential factors, including officers' perceptions of gender roles, acceptance of domestic violence, and their level of active acceptance of the system. Notably, active acceptance emerged as the most significant variable, while perceiving domestic violence as a personal issue correlated with a decreased likelihood of implementing emergency measures. Additionally, the officers' rank and years of service were examined to determine their impact on the possibility of implementation. The findings indicated that officers often prioritized victims' wishes over their statements in domestic violence cases. This highlights the need for policy efforts to enhance domestic violence awareness and strengthen the effectiveness of the emergency measures system. These insights identify gaps in the domestic violence response framework and serve as a foundation for future policy enhancements.
