법교육의 핵심 영역이라고 할 수 있는 법의식에 관한 기존의 연구들은 법의식의 변화가 곧바로 법적 행동의 변화로 이어질 것이라는 기대를 암묵적으로 전제하고 있었다. 이러한 전제가 올바른 것인지 알아보기 위해 본 연구에서는 법의식과 행동 사이의 관계를 확인하기 위해 학생들이 교칙에 대해 갖는 태도가 실제 교칙준수행동과 어떤 연관이 있는지를 경험적으로 확인하였다. 연구결과 교칙에 대한 태도는 교칙 가운데 용의불량항목에만 영향을 주며, 태도의 여러 요인 중에서도 행동적 영역만이 통계적으로 유의미한 연관관계가 있는 것으로 확인되었다. 이는 법의식과 법적 행동 사이에 분명한 괴리가 있음을 보여주는 것이다. 향후 이러한 괴리의 원인과 이를 줄이기 위한 효과적인 법교육 방법에 대한 논의가 보다 활성화되어야 할 것으로 보인다.
Abstract
The study about legal consciousness consists the essential part of Law-Related Education research. Most of the studies have premise that there would be deep and direct relation between legal consciousness and legal behaviour. To verify this premise, this study focuses on the problems about the attitudes towards school rules as a fundamental approach on students' violative behavior of school rules. One of the reasons why the students violate school rules can be the attitude towards school rules. This is because the wrong attitude towards school rules may influence on the violate behavior of school rules. In consequence, I felt some necessity of analyzing how the attitude towards school rules which can be a law in school affects on the students' behavior of following the law. As shown in the analysis, only behavioral domain of the three domains about the school rules influences on the law-abiding act of the students. That means, other several factors are working in the link from attitude to behavior. That is, the attitude towards the school rules has an effect on other factors in the process of violating rules so it is necessary to investigate about which other factors can influence on the act of violating rules through the follow-up studies. Furthermore, it is important to study which factors, except for legal consciousness, have an influence on the act of following the rules, and to continue the research which develops various programs for improving the level the student's law-abiding behavior.
