법교육과 법의식 발달의 관계

본 연구의 목적은 공식적이며 의도적인 학교 교육에서의 법교육이 청소년들의 법의식 발달에 미치는 영향을 분석하여, 청소년들의 법의식 함양을 제고할 수 있는 법 교육과정 및 교수법 개발 등에 중요한 시사점을 제공하고자 하는 것이다. 이를 위하여 법교육과 법의식 발달에 관한 이론 및법의식 발달에 영향을 미치는 변인들에 대하여 문헌 연구를 하였다. 그리고 서울시 소재 인문계 고등학교 3학년 남․여학생 600명을 대상으로 설문 조사를 실시한 후, 학습자의 사회경제적 특성, 집단특성,법과 사회교과 관련 변인에 따른 법의식 발달 수준 차이를 통계적 분석을 통하여 살펴보았다. 그 결과 학습자의 성별, 법 관련 지식습득경로,법과 사회교과에 대한 자기이해도, 성적, 흥미도가 학습자의 법의식 발달에 유의미한 영향을 미치는 것으로 나타났다. 본 연구의 결론은 다음과 같다. 첫째, 개별 학습자의 생물학적 특성을 고려한 법교육 내용 및 교수법이 개발되어야 한다. 둘째, 학습자의 법 관련 지식습득경로를 고려한 학습자료 및 교수법 개발을 통하여 학습자의 법교육에 대한 흥미와 참여도를 향상시켜야 한다. 셋째, 학습자들의 법의식 수준에 대한 사전 연구 및 분석을 통하여 학습자의 수준에 적합한 법교육이 이루어지도록 해야 한다. 본 연구는 학교 교육에서의 법교육이 학습자의 법의식 발달에 미치는 영향을 실증적으로 분석하였다는 점에서 의의를 지니며, 향후 법교육 과정 및 교수-학습 전략과 법교육 정책 수립 방향에중요한 시사점을 제공할 것으로 보인다.
Abstract
The purpose of this study was to provide important implications for the curriculum of law,and to develop teaching methods which could improve our youths' law-abiding spirit by analyzing the influence of the law education in official and purposeful schooling on the development of our youths' law consciousness. To achieve this aim, this study developed a questionnaire answered by 600 male and female, third grade, academic high school students in Seoul. An examination by statistic method of the students’ scores on the legal consciousness questionnaire and the set independent variables of the study indicated a significant relationship. The results of the study indicate that: first, law education and teaching methodologies, which take into account the demographical features of the individuals, need to be developed. Second,law education in schools should consider the learners' route for attaining knowledge, and should include improvements in teaching methods and learning materials. This would help learners to participate more and have a greater interest in law education. Third, law education suitable to the level of the learner should be implemented in order to enhance legal consciousness. To achieve this, methodical study on the level of legal consciousness of current learners must be done in advance. This study is significant in that it proposes two methods for the stimulation of the development of legal consciousness in students. Law education in schoolsl should be composed of suitable subject content that considers learners' levels and variables, and generates interesting teaching materials. The results of this study could provide important suggestions for the establishment of policies related to law education in schools.
