사회과 법교육의 중요한 목표 중의 하나는 준법교육을 통한 범죄 예방이다. 이때 범죄 예방을 위해서 선행되어야 할 것은 범죄의 개념에 대한 이해이다. 이에 본 연구에서는 범죄의 개념이 2015 개정교육과정에서 어떻게 제시되고 있는지 살펴보고, 새롭게 범죄 관련 교육과정을 어떻게 구성해야 하는지 고찰해 보았다. 현재 초중고 교육과정에서는 범죄의 개념에 대해 피상적으로 다루고 있어, 추후 범죄의 개념을 어떻게 다루어야 하는지에 대해 심도 있는 연구가 필요할 것으로 보인다. 우리나라 법 개념이 독일식 개념법학 이론을 수용했음을 고려할 때, 범죄의 개념과 관련하여 나선형 교육과정에 따른 교육과정을 구성하고, 그에 대한 개념학습이 어떻게 이루어져야 하는지에 대한 후속 연구가 필요할 것으로 보인다.
Abstract
One of the important goals pursued by law education addressed in social studies is crime prevention through law-abiding education. Here, what has to be preceded for crime prevention is an understanding of the concept of crime. Hereupon, this study looked into how the concept of crime is suggested in the 2015 revised curriculum, and considered how to organize and renew the curriculum related to a crime. At present, the elementary, middle, high school curriculum seems to be superficially dealing with the concept of crime; in this context, this study thinks that it’s necessary to do in-depth research on how to address the further concept of crime. Considering that Korean concept of law accepted the German Conception Jurisprudence(Begriffsjurisprudenz) theory, it seems to be necessary to organize the curriculum consequent on the spiral curriculum in regard to the concept of crime, and also there needs to be a follow-up research on how the concept learning thereof has to be done.
