에페소스에 발견된 속주 아시아 관세법에는 ‘안드로스 아카투’라는 표현이 분명히 드러난다. 이는 라틴어의 ‘비르 보누스’의 번역이라는 점에는 이의가 없다. 이런 표현이 적용되는 집단은 일반적으로 교양계층으로 인식된다. 그러나 비문에서 재량권을 행사하는 존재로서의 비르 보누스는 그런 존재가 아니라 특별한 공공의 직책을 부여받은 인물이라고 보아야 한다. 이들에 관해서 일찍이 주목한 크리스찬 마이어는 공화정 말기에 원로원의원이나 기사 신분과는 다른 독자적인 세력으로 이들이 활동하였음에 주목했다. 그러면서 이들의 정체성에 관해서 연구 과제로 남겨두었던 것이다. 이런 제안은 별로 주목을 끌지 못했으나, 에페소스의 관세법비문은 이 과제에 접근할 수 있는 단서를 제공한 셈이다. 필자는 이들이 국가의 재산이 되는 페르가뭄 왕의 세관이나 부속건물에 관한 관할권을 가지고 있음에 주목하였고, 청부업자들에 대한 재량권을 가진 상위 관계에 있음을 주목하였다. 이런 권한을 가지는 자들은 일단 국고나 국유재산에 관여해 왔던 자들임을 추론할 수 있었다. 카토의 문헌에는 포도주의 거래와 관련하여 중재인으로서 활약하고 있는 ‘보니’의 사례들이 나온다. 이들이 국유재산에 관리에 재량권을 가진다면, 이것은 국가에 대해서 일종의 채권을 가진 사람들이 누릴 수 있는 권리라고 보아야 할 것이다. 필자는 이런 권리를 가진 자로 파악될 수 있는 알려진 유일한 집단이 바로 ‘트리부니 아이라리이’라고 본다. 즉 필자는 ‘보니’가 ‘트리부니 아이라리이’의 다른 표현이라는 가설을 제시한다. 물론 모든 보니가 트리부니 아이라리이라고 볼 수는 없다. 그러나 애초 보니는 애초 원로원의원에 대한 별칭이었으나, 기원전 133년경 원로원의원이 옵티마테스라는 명칭을 독점함으로써 선량은 기사 신분을 주로 지칭하다가, 대개 기원전 70년대 이후 ‘트리부니 아이라리이’도 지칭하게 되었을 것이다. 재판에서 배심원 1/3을 원로원의원, 기사 신분과 나눈 이들의 중요성은 그들이 가진 기능에서 설명된다. 이로써 크리스찬 마이어가 제기했던 ‘보니’의 정체 문제를 미흡하나마 해명했다. 이 연구는 원로원의원이나 기사 외에도 ‘보니’라고 여겨지는 트리부니 아이라리이라는 신분의 중요성을 부각하여 로마 사회를 보게 할 것이다. 앞으로 이들과 키케로의 정치사상과 연관하여 논의하면 흥미로울 것으로 보인다.
Abstract
The Greek phrase, ‘andros agathou’ can be seen clearly in the famous inscription containing the customs law of Asia. The Greek phrase is recognized as a translation of Latin, vir bonus, which generally represents a Roman elite in the Republican period and is translated as a loyalist. Christian Meyer noticed the independent behaviour of the ‘viri boni’ in the late Roman republic and proposed the task of solving their identity to researchers in 1980. I noticed that the same Greek phrase appears in the inscription with the task in mind. The ‘vir bonus’ had a right of decision about the use of the customs buildings for the publicans there. So it is natural that the ‘viri boni’ were not only elites but also special agents of state property, as the bequeathed properties of the Pergamon kingdom to the Romans also belonged to the Roman state property. They also appear to have the role of paying for the soldiers and for the corns to be distributed to Roman citizens in the literal texts. Their role can be seen as the same as that of the ‘tribuni aerarii.’ It seems certain that ‘viri boni’ or ‘boni’ is a technical expression of ‘tribuni aerarii ’ in analyzing some cases after 75 BC. As it is well known, they had occupied one third of the jury panel in the permanent courts, enjoying the same concurrence with the senators and the equestrian order after 70 B.C. If it is assumed certain that the ‘boni’ designated the ‘tribuni aerarii’ after 70s B.C., small evidence is found for solving the problem proposed by Christian Meyer. It would be a more interesting task for us to investigate the relation between the shift of Ciceronian political ideas and the ‘boni’ from this perspective.
