Abstract

This paper examines the power and limits of Neo-Babylonian patriarchs based on cuneiform tablets from the Period. The study is analyzed through economic, social, and legal aspects. The results of the study are as follows. Economically, a patriarch could leverage his wife’s dowry but faced constraints as he couldn’t diminish its amount. The ultimate authority concerning inheritance rested with the head of the household. While tradition dictated the division of wealth, the patriarch retained the liberty to designate a individual within or outside the family for special inheritance under specific conditions. Socially, the father of the family wielded significant influence over its members. For instance, if a temple woman slave married a man with the social status of mār banî, temple authorities couldn’t reclaim the women into their labor force, illustrating the social power of mār banî, a patriarch, being beyond the reach of the temple’s authority. The patriarch’s moral authority extended to the household, even to slaves, challenging the prevailing image of a corrupt Babylon. Legally, the patriarch held the decisive authority to recognize or reject a newborn as a family member, including children born between the patriarch and a female slave. Only upon the patriarch’s acceptance were these children acknowledged as his own. While the patriarch possessed the ability to sell his children, this rarely occurred under normal circumstances. However, this prerogative was subject to the temple’s authority if the patriarch was a temple slave. This research indicates that while patriarchs in the Neo-Babylonian Period wielded substantial authority within their households, their capabilities were intricately circumscribed by social, cultural regulations, and at times, by the patriarch’s social standing.
