Abstract

As the needs of the settlement on divided surface right is increasing, the appraisals of the right are happening more and more. However, the appraisal on divided surface right is very difficult owing to the characteristics of the right and inadequate appraisal system. The purpose of this study is to analyze the issues about the appraisal on divided surface right and to suggest improvements. The method of study is a literature research that analyzes books, research papers, regulations, precedents, cases etc. The rational appraisal methods on divided surface right are as follows: The first method is to appraise on the basis of the reward on original settlement of right. The second method is to appraise on the basis of the depreciation rate due to the right. The third one is to appraise on the basis of the similar cases of neighborhood. The forth one is to appraise with a cost approach that calculates reward on settlement of the right(expected amount of compensation) at the date of value. The fifth one is to appraise based on the gap in net operating income of objective land. The final one is to appraise on the basis of excess profits from the divided surface right.
