본 연구는 일반 토지의 평가산정 과정과 달리 감액평가를 하는 도로부지에 대하여 지금까지도 일률적인 1/5 이내 또는 1/3 이내로 평가하는 이론적ㆍ법적 근거를 살펴보고, 특히 감액보상의 이론적 근거인 화체이론의 논리적 모순과 감액보상의 문제점을 도출하여 그 개선방향을 제언하는 데 궁극적인 목적을 두고 수행하였다. 본 연구의 범위로는 현행법에 의한 도로의 종류와 보상액산정에 관한 방법과 도로부지를 감액보상하는 이론적 근거로서 통설적인 입장을 취하는 화체이론과 법적 근거로서 토지보상법상의 관계규정을 범위로 하며, 연구방법으로는 문헌조사법과 판례조사법을 병행하여 서술적 기술을 바탕으로 새로운 도로부지 평가액 산정방법에 대한 문제점을 밝히고자 하였다. 연구수행을 통하여, 본 연구는 도로에 따른 보상금액 과정에서의 감액의 근거, 건축법 제35조의 도로와 실무적용상의 도로 감액, 미보상도로의 보상기준, 그리고 실무상 적용과정에서의 사업시행자와 감정평가사가 염두해 두어야 할 사항 등에 관한 개별적 문제점과 개선방향을 제언하였다.
Abstract
This study aimed to examine the arguable problems and legal issues in compensation for road. In order to achieve this goal, we intended to investigate legal principles of issues by annotating the existing documents and judicial precedents. Then, we described the core of a topic for discussion in details. After studying, we recognized that the cost compensation system is not suited for the best solution because there is difference between the cases. And also, the compensation system of road does not exactly fit the case. Therefore, this study proposed that the government should firstly make an allowance for the reason why the difference has been existed at the compensation process. And then, it must take the most effective measures available by providing the multilateral solutions which is mixed above alternatives. Furthermore, this study urged the need of legal and systematical improvement.
