Abstract

It was confirmed that the responses of South Korea and Japan respectively to the legal status and treatment of Zainichi Koreans in the 1970s differed markedly. While South Korea actively addressed issues related to the permanent residency and treatment of Zainichi Koreans, Japan maintained its longstanding stance of reinforcing administrative measures for forced deportation of them, ultimately leading to the infringement of their fundamental rights. However, Japan’s ratification of the International Covenants on Human Rights (ICHR) – i.e., the International Covenants on Civil and Political Rights (ICCPR) and the International Covenants on Economic, Social and Cultural Rights (ICESCR) – temporarily curtailed its forced deportation of agreement-based permanent residents. Given the widespread mistreatment, discrimination, and psychological abuse that the Japanese government perpetrated at that time towards Zainichi Koreans, it was perhaps inevitable that a series of human rights violations would become an international issue. In this sense, the severe discrimination and prejudice that Zainichi Koreans had long faced – spanning such issues as permanent residency, pensions, employment, and education – became widely recognized in the international community. This heightened awareness was not only the result of efforts by Zainichi Koreans themselves but also significantly influenced by numerous civil society organizations as well as a group of politicians from the opposition parties in Japan. With the ratification of the ICHR, the Japanese government was obligated to repeal or amend relevant laws that conflicted with these treaties, and was compelled to take special measures to address discrimination against Zainichi Koreans. Although this issue persisted throughout the 1970s, no substantive resolution was reached in the Korea-Japan working-level meeting on legal status of Zainichi Koreans. This prolonged impasse was likely one of the factors that led to the level of discussions on the associated issues being elevated, accordingly culminating in the initiation of the Korea-Japan senior working-level meeting on their legal status, marking a new phase in negotiations.
