컴퓨터, 휴대폰 등 전자기기와 인터넷의 발달은 인류생활을 근본적으로 바꾸어 놓았다. 이와 같은 전자기기와 인터넷의 발달은 우리에게 온갖 편리함과 즐거움을 선사해 왔지만, 다른 한편 사이버 음란물유포, 사이버 명예훼손, 보이스피싱, 인터넷 도박, 인터넷상 저작권침해 등 사이버범죄도 증가시켜왔다. 본고의 목적은 이와 같은 현실에 입각하여, 한국 검찰의 사이버범죄대응 시스템 및 증거수집절차 등 사이버범죄에 대한 수사실무를 소개하는데 있다. 이를 위해 본고에서는 먼저 한국 검찰 내에서의 사이버범죄 수사체계를 살펴보고, 디지털증거에 대한 압수수색을 중심으로 사이버범죄에 대한수사절차를 구체적으로 검토한다. 다음으로는 이와 같은 논의들을 바탕으로디지털증거에 대한 압수수색의 방법, 디지털증거에 대한 압수수색에서 압수수색영장의 집행 방법 등과 같이 사이버범죄 수사와 관련된 실무상의 쟁점들에 대해 검토한다.
Abstract
The development of electronic devices, such as computers and mobile phones, and the Internet have fundamentally changed human life. Such development of electronic devices and the Internet has provided us with all kinds of convenience and pleasure. However, cybercrimes, including the spread of cyber pornography, cyber libel, voice phishing, Internet gambling, and copyright infringement on the Internet, has increased. The purpose of this article is to introduce cybercrime investigative practices such as cybercrime response system and evidence collection procedure of Korean prosecutors. For this purpose, this article first examines the cyber criminal investigation system in the Korean prosecutor 's office and the criminal investigation procedure for cybercrime. Additionally, based on those discussions, this article examines practical issues related to cyber crime investigation such as methods of search and seizure of digital evidence, enforcement of the search and seizure warrants, and so on.
