사회생물학적 관점으로 본 도덕과 형사법체계 - 인간본성과 예방처분을 중심으로-

국가의 강력한 규제수단인 형법과 국가형벌권의 과도한 행사는 늘 경계의 대상이 되어왔다. 계몽주의시대 혁명을 이끌었던 동인에도 국가에 의한 자의적 형벌권의 행사가 한 몫 하였음은 주지의 사실이다. 그럼에도 우리사회는 극단적인 사회방위론적 형법의 태도와 가중주의 일변도의 형벌의 팽창을 막지 않거나 막을 수 없는 상태에 이르렀다. 따라서 본 논문에서는 실질적 죄형법정주의가 과잉금지의 원칙이라는 형법의 한계를 제시하였음에도 불구하고, 그것만으로는 제동이 걸리지 않는 형법과 형벌의 팽창의 한계가 어느 지점인가를 찾고자 하는 도구로서 사회생물학적 접근을 제시하고자 한다. 여기에서는 사회생물학, 폭력의 기원, 사회적 뇌 가설, 마음이론, 윤리의 진화론적 측면 등 다양한 학제적 접근을 통해 인간본성과 윤리 또는 도덕과의 관계를 설정하기 위하여, 인간의 진화과정에서 어떻게 공동체의식이 생기는지 이론적인 부분들을 살펴보았다. 그리고 형법의 보호적 기능이 대상으로 하는 사회윤리적 행위가치가 인간의 진화과정 및 공동체의식과 어떠한 관계에 있는지를 확인하고자 하였고, 사회적 뇌 가설을 통해 인간의 공감능력의 발현으로 공동체의 규범이 형성되고 협력적이고 이타적인 윤리적 행위가 진화과정에서 나타났음을 확인하였다. 또한 자연상태에서 인간이 상호협력하고 공동체의식을 가질 수 있는 규모보다 훨씬 큰 인위적 조직인 국가에 의하여 통제되는 형법과 형벌은 인간본성을 뛰어넘거나 반해서는 안된다는 점을 조명하고자 하였다. 그로부터 공동체의 일원이기도 한 범죄인을 영구히 사회로부터 격리하거나 배제하는 응보적인 형벌들은 인간본성에 반한다는 점, 따라서 악의적이고 고통의 부과만을 목적으로 하는 제재가 아닌 또 다른 의미의 처분이 필요하다는 결론에 이르고자 한다.
Abstract
It has been criticized that nations administrative justice and retributive criminal justice system are using their power excessively in the name of righteousness ethically. So in these days our society is not able to prevent or forbid aggravated punishment and expanding area of criminal laws, which lead our society to so-called "safety society" in which offender can never enter entirely. So our society solve this problem and pursue the way to promote communal spirit and in this research suggest sociobiology as one of solutions or clues. Sociobiology concerned with human natures and human behavior is the theory to aim to explain all social phenomenons as evolution theory based on biology. Today the question of human nature is closely related to sociobiology what is an field that animal and human social behavior biologically explain the evolution of the organization. According to those explanations, human morality is the result of evolutionary adaptations which were evolved in the process of natural selection because they were useful for our ancestor's survival and reproduction. Moreover, the latest researches about sociobiology find out and advance those theories like that the theory of mind, spontaneous evolution, social brain theory, and so forth. Those theories show the relation of human natures and ethic and communal spirit which has been with human history and reveal that human sympathy is the result of evolution. So criminal law system should not be tightened beyond human nature because if criminal law system wants member of its society to live well and safe, criminal law system as itself respect human nature and communal spirit as the product of human evolution. Finally in this paper will suggest prevention measures instead of security measures.
