이 논문은 논자에게 소크라테스(469-399 BC)로 하여금 탈옥을 거부하게 한 두 원인이라고 여겨지는 아테네 민주주의 국법, 그리고 그에게 전해지는 ‘신(神)의 전언(傳言)인 다이모니온에 관한 글이다. 이 글을 통해서 그의 아테네 민주주의 국법에 대한 견해, 그리고 국법에 대한 복종불복종의 관점에서 변론과 크리톤 사이에 존재한다고 여겨져왔던 모순의 문제를 재검토하려 한다.‘제2장 소크라테스 철학의 종교적 기반’에서는 그의 철학의 종교적 기반으로 여겨지는 신 또는 ‘다이모니온’을 살펴보고자 한다. ‘제3장: 크리톤: 아테네 민주주의 국법에 대한 소크라테스의 견해’에서는 크리톤 전체를 통해 왜 그가 탈옥을 거부하였는지를 아테네 민주주의 국법에 대한 그의 견해와 결부시켜 살펴보고자 한다. 그가 아테네 민주주의 국법을 비록 흠이 있다 하더라도 현실세계에서 존재할 수 있는 최상의 법으로 생각하고 있었고, 그러한 생각이 탈옥을 거부하게 하였음을 제시할 것이다. ‘제4장: “옳고 그름의 전문가(ho epain peri tn dikain adikn, 크리톤 48a)”’에서는 소크라테스로 하여금 탈옥을 거부하게 한 또다른 원인으로 다이모니온 또는 “신으로부터의 전언(傳言)”이 있었음을 주장하고자 한다. 그의 탈옥거부는 겉으로는 국법의 명을 따른 결과로 보이지만, 그 이전에 그리고 근본적으로는 신의 명령을 따른 것이었음을, 크리톤의 몇 구절과 변론의 최후진술 부분에 초점을 맞추어, 보이고자 한다.
Abstract
This article concerns the two agencies who caused Socrates to refuse to escpae: the Athenian Democratic Laws and his daimonion. I will elucidate his opinion on the Athenian Laws and reexamine the traditional issue on the contradiction between Apology, where he said that he should obey the god rather than the jurors or, and Crito, where he seemed to accept jurors' decision and refused to escape. Socrates made the Athenian laws, personified by himself, tell that “so much more than the other Athenians were you satisfied with the city and evidently therefore with us, its laws...”(Crito 52e-53a), or he himself confessed the Athenian democratic laws was “the highest laws (νόμοι οἱ μέγιστοι)”(Crito 53d-e). I try to show by analyzing Crito on the whole that it was for the sake of the Athenian Democratic Laws that Socrates refused to escape. I also try to show another agent, his daimonion or the divine sign, who caused Socrates to refuse to escape. The reason why he obeyed the Athenian Laws and refused to escape was that he thought that it was God's will to follow “the highest laws”. Regarding his obedience to the daimonion there is no contradiction between Apology and Crito.
