이승만이 건국의 영웅이든, 독재자이든 현대사의 주역이었음에는 틀림없다. 본고는 1948년 제정된 『제헌헌법』이 이승만의 이름으로 공포되었다는 점을 상기시키고자 한다. 일반적으로 유진오가 제헌헌법을 제정한 것으로 보는 것이 통설이지만, 제헌헌법은 그렇게 단순한 제정 과정을 거치지 않았다. 그 헌법에는 더 깊고 심오한 사상이 담겨 있다. 언론인 이승만은 평소 ‘공화주의’, ‘자유주의’를 논의했고, 1899년에는 그와 관련된 주장으로 종신형까지 선고받았던 인물이라 우리나라에서는 공화주의를 주장한 상징적 인물로 간주되었다. 그는 1904년 러일 전쟁이 한참이었던 당시, 『독립정신』이란 책에서 ‘공화주의’의 사상에 대해 서술하였다. 그리고 이러한 공화주의 사상은 제헌헌법에서 깊숙이 논의되었는데, 이 헌법에서는 ‘자유, 평등, 책임’ 그리고 ‘국민 생활의 균등한 향상’, ‘영구적인 국제 평화’ 등 자유주의, 공화주의 사상에 대해 집중적으로 조명하였다. 따라서 본 연구는 이승만의 저서인 『독립정신』과 《제국신문》에 기고한 그의 글을 바탕으로 공화주의 제헌헌법 정신을 조망한다. 물론 공화주의 사상은 서구의 보편적 가치와 맥을 같이한다.
Abstract
Syngman Lee became the first president of the Republic of Korea. Before the first election, When the First Constitution was announced by his name, he was the first chairman of the National Assembly. The main ideas of republicanism were in the first Constitution of the Republic of KoreaIn 1898, Syngman Lee worked as the chief editor of Jaekoeok Daily newspaper. At that time, Korea was constitutional monarchy. Syngman Lee wanted to adopt republicanism without any king. Because he leaded a protest movement, Manmin Kongdong Hoe in 1898, He was given life imprisonment. In 1904, Syngman Lee in Hansung prison, wrote the book, Spirit of Independence, and Jaekoek Daily newspaper, at the time when war between Russia and Japan broke out. In this paper, Syngman Lee's ideas in Jaekoeok Daily Newspaper and Spirit of Independence will be the major topic. And then the application of his ideas to the First Constitution discussed . The last part of this paper will be the history of republicanism and the ideas of Epicurism and Stoicism that are in this system. Eventually, the aim of this paper will be to analyze the ideas that influenced the First Constitution.
