Abstract
Although the provision of goods and services using artificial intelligence in the capital market is commercialized in some part, it is expected that artificial intelligence will take time to judge and direct without human intervention. Nonetheless, in the capital market, where the use of artificial intelligence is spreading rapidly, proactive action is needed in response to the risk factors which artificial intelligence could cause. The recent technological change is proceeding at a rate which is not comparable to the previous one, and the legal system and its paradigm, which have governed the existing capital market, face different challenges. At the heart of the capital market is information, which enables the processing of big data, so that the amount of information, processing speed, and accuracy can not be compared with the past. This feature of the technology development is very fast, but the problem is that the technologies are being used quickly without being sufficiently pre-tested. Therefore, proactive response is required especially in terms of supervision. First and foremost, regulatory processes in the regulatory body need to detect and quickly reflect the nature and rapid changes of these technologies. On the other hand, in order to protect the investors, which is the purpose of the Capital Market Law, faithful investor protection measure should be implemented and functioned against the use of intelligent artificial intelligence. For this purpose, it is necessary to faithfully comply with investor identification and suitability rules in the Capital Markets Law. In particular, institutional arrangements and support will be needed regarding the duty of care of financial investment companies. On the other hand, regarding high-frequency transactions, it is necessary to register high-frequency traders, imposed risk management obligations, enforce registration of supervisor of algorithm trading strategies, reinforce internal control of algorithms, train employees' compensation, and enter ethics into intelligent AI algorithms and so on. In addition to regulating such behavior, it is necessary to consider the establishment of a victim compensation fund so that investors can be protected. In addition, to strengthen the monitoring of the market, it is necessary to update the monitoring algorithm of the exchange and regularly test and record the effect. In particular, it is urgent to strengthen the supervision and effectiveness of regulatory supervisor. It is necessary for the supervisory body to conduct surveys on the major risks and issues that artificial intelligence may cause in the future and regularly present them. These surveys can increase the competence of supervisory agencies by identifying the current status and problems of the industry, and expect the industry to be solved voluntarily. On the other hand, RegTech should be used for the protection of investors and fair market order considering that the capital market becomes increasingly complicated and more difficult to monitor and control. In order to effectively use RegTech for investor protection and market surveillance, there is a need for governmental attention to methods and systemic support for the ecosystem of these industries.
