Abstract
Under the Article 2 of Korean Copyright Act, works mean creations that express human idea or emotion, and copyright protection is available for creative expression. In order to examine the standards for copyrightability, works must satisfy the threshold of expression which is based on idea-expression or fact-expression dichotomy, and the threshold of creativity on a distinguishing original works from copied works. The same standards are to be applied regardless of whether literary and artistic works or functional works are. Functional works are works whose sole or primary purpose is utilitarian function. There would be no copyright protection for works having functional idea such as system, procedure and method of operation. Generally speaking, it is easy to say for literary and artistic work to be copyrightable, while hard to say for functional works. The question is in determining whether it would be protected if there are works with utilitarian and expressive factors as well. In korean practice, courts consider functional works as copyrightable expression, then deal with whether the works satisfy the threshold of the creativity. So far the practice of korean courts have a narrower view on ‘merger doctrine’ for a long time, and are not used to applying it, comparing with the practice of other countries. The article explores the legal issues related with the scope of copyright protection for functional(/factual) works along with ‘merger doctrine’. When certain works express a utilitarian idea which is deemed creative, it is a merger that idea and expression are inseparable. The works cannot receive protection under ‘merger doctrine’ of copyright law. In information society the public domain has to be broader for getting the creation of high-quality intellectual property with other’s idea, and it relies on the free flow of information. The problem solving is ‘merger doctrine’ which plays a greater role for the access of idea.
