Abstract
The court determines whether an act constitutes reproduction of an pre-existing work or preparation of a derivative work based on whether new creative elements are added, considering that both reproduction and preparation of derivative works require substantial similarity to the original work. However, it appears that the court has become overly fixated on the concept of adding new creative elements, neglecting to consider what form or manner such new creativity should take. Under the derivative work principle—wherein a new independent work arises from translating, arranging, modifying, or otherwise transforming the original work’s expression—the determination should hinge on whether new original expression is added through substantial variation integrally incorporating the original’s expression. Furthermore, given the nature of derivative works that add new creative elements to the original work's creative expression, the expression subject to this new creative addition will be the original work's inherent expression, not its external expression.
