선출원 특허발명과 동일한 후출원 특허발명의 실시행위가 선출원 특허권을 침해하는 것으로 보아야 하는지에 관하여는 침해긍정설과 부정설이 대립하고 있고, 현재 명시적인 대법원의 판결은 아직 없는 상태이다. 이는 실무상 후출원 특허발명의 권리행사의 항변(후출원 특허의 항변)을 허용할 것인지의 문제이기도 하다. 필자는 이원적 시스템을 유지하고 있는 현행 법질서를 존중하고 대법원의 다양한판례이론과 조화롭게 해석하는 차원에서 후출원 특허발명의 권리행사의 항변은 허용은 하되, 후출원 특허에 무효사유가 있음이 명백하여 특허무효심판에 의하여 특허가 무효로 될 것이 확실히 예견되는 사정이 있는 경우에는 그 항변을 제한하여 특허침해의 여부를 판단하고, 나아가 민사 손해배상책임과 형사책임의 발생에 관하여는 그 특유의 요건을 구비하고 있는지 여부에 따라 판단하여야 한다는 입장을 취하여 보았다
Abstract
Where two or more patent applications claiming identical inventions are filed on different dates, only the applicant of the patent application with the earlier filing date may obtain a patent for the invention. Where the patent has been granted in violation first-to-file provision, an interested party or an examiner may request a trial to invalidate the patent. This paper deals with the issue on whether it infringes the patent with an earlier application date to practice the patent with a later application date before the latter is decided invalid. This issue is controversial and there has still been no Supreme Court case on this issue. This paper argues that it is not infringement of the earlier patent until the later patent is decided invalid, except that it is infringement if the later patent would be definitely expected to be decided invalid because there is clear invalidation grounds for the patent.
