이민정책의 규범적 기초로서 J. Rawls ‘만민법’의 유용성과 정책적 함의

초록

이 글은 이민자가 우리 공동체의 사회･문화･정치 영역에서 어떤 규범적 의미를 갖고 있는지를Rawls의 만민법을 통해 들여다본다. 만민법은 우리 공동체의 이념적, 철학적 관용과 포용의 가치들이 어떻게 만민이 사는 공동체에 투영하여야 하는가에 대한 질문에 적절한 대답과 처방을 준다. Rawls는 만민법이 국가를 떠난 사람들, 서로 다른 민족･인종을 포함하는 사람들이 견해를 달리하는 쟁점들을 고려하며 정의의 원칙들을 새로이 제시하는 것이라고 하였다(Rawls, 1999). 여기에서 “만민의 사회(Society of Peoples)"는 현실주의적 유토피아가 갖는 이상과 원칙들을 준수하는 모든 사람을 지칭하는 용어이다. 국가에 속한 만민은 더 좋은 조건과 제도를 위한 변화 그리고 공동체의 신념･가치들을 함께 공유하고자 하는 노력을 ‘한계를 정하지 않고’ 현실에서 수행해야 한다. 이러한 의미에서 만민의 사회는이민자를 대하는 원칙에도 이 기본 틀을 적용한다. 이를테면 만민의 사회는 이주의 권리를 허용하고이를 위해 협조해야 한다. 만민의 사회에서 이주는 본질적인 것이다. 자유주의 사회들은 만민이 합당한 자격을 얻으면 이러한 권리를 예외 없이 허용해야 한다. 이민자가 어느 곳에서든지 합당하게편견 없이 받아들여질 권리가 보장되지 않으면 해외 이주의 권리는 사실상 그 근본 취지를 상실하게된다(Rawls, 1999:124). 어떠한 경우에도 이주와 이주로 인한 인간의 기본 권리는 실질적인 것으로 보장되어야 한다. 이에 ‘만민법’은 문화 다양성･개방성의 인정을 통한 다원주의의 수용, 인권･평 등･관용의 증진, 국민국가 중심의 이민정책에서 만민연합의 이민정책으로 패러다임의 전환을 촉구한다. 이것은 많은 국가들이 헌법 전문에서 공동체의 철학적･규범적 가치를 제시하며 이민자와 공존하려는 다원주의 정신을 강조하는 것과도 맥락을 같이한다.

Abstract

This study has looked into what immigrants are normatively meant in social, cultural, and political areas of our society through Rawls’s ‘The Law of Peoples'. ‘The Law of Peoples' gives appropriate answer and measures to the question about how ideological and philosophical generosity and magnanimous value of our community should be projected onto the community where peoples live. Rawls mentioned that ‘The Law of Peoples' refers to a new suggest of principles of justice by taking account of issues in which immigrants － different racial or ethnic groups of people － have differences (Rawls, 1999). “Society of Peoples” in this is the term for all the people that observe ideals and principles, which a realistic utopia entails. Peoples belonging to a country have to make efforts in this reality without setting limits, which attempt to share changes for better conditions and system and the community’s beliefs and values together. In this sense, Society of Peoples apply such framework even for the principle which is set to behave toward immigrants. For example, Society of Peoples should allow the rights of migration and coordinate efforts. Migration is of the essence in the Society of Peoples. If peoples become qualified reasonably in the liberal societies, such rights should be allowed without exception. If immigrants are not guaranteed to be accepted anywhere without prejudice, the rights of overseas migration shall lose its fundamental purpose. Immigration and basic human rights by immigration should be de facto guaranteed under any circumstances. Therefore, ‘The Law of Peoples' urges to embrace Pluralism by accepting the cultural diversity and openness, to promote human rights, equality and generosity, and to change a paradigm from the nation-state centered immigration policy to peoples’s alliance immigration policy. This can also be understood that in the constitutional text many countries suggest philosophical and normative values of the community and emphasize on the spirit of Pluralism, in which they attempt to share with immigrants.
