본 논문은 한국 거대정당의 여론조사 공천방식이 민주주의의 4대 선거 원칙(보통ㆍ평등ㆍ직접ㆍ비밀선거)에 부합하는지를 공정성의 관점에서 분석한다. 기존의 하향식 공천은 비민주성과 폐쇄성으로 비판받았으며, 거대정당은 이를 개선하고자 상향식인 여론조사 공천방식을 도입하여 활용하고 있다. 그러나 이 방식은 실제로는 일반 국민에게 동등한 참여 기회를 부여하지 못하는 ‘제한된 참여’ 구조, 1인 1표와 1표 1가치라는 ‘표의 등가성 원칙 위배’ 문제, 자발적이고 책임 있는 참여를 제약하는 수동적 응답 방식으로 ‘비자발성’, 일반 국민의 자유로운 판단을 방해하는 ‘자율적 판단 훼손 및 조작 가능성’ 등의 문제를 지닌 것으로 나타났다. 이로 인해 여론조사 공천방식은 정당민주주의 실현의 도구라기보다 정당의 전략적 이해에 따라 활용되고 있으며, 이는 공천의 본래 취지와 괴리된다. 따라서 형식적 개방성을 넘어 실질적으로 민주주의 구현, 일반 국민의 책임 있는 참여, 대표성 확보를 목표로 공천방식의 근본적인 재설계가 필요하다.
Abstract
This study analyses whether the public opinion survey method employed by major political parties in South Korea for candidate selection aligns with the four principles of democratic elections — universal, equal, direct, and secret suffrage — from a fairness perspective. Traditional top-down candidate selection methods have been criticised for their undemocratic and opaque nature, leading major parties to adopt upward nomination mechanisms, such as the public opinion surveys for candidate selection. However, this method raises several concerns it has a ‘restricted participation’ structure that fails to provide equal opportunities for all voters, it violates of the ‘one person, one vote’ and ‘one vote, one value’ principles, it leads to ‘involuntary participation’ due to the passive nature of responses, and it causes the ‘erosion of autonomous judgement’ due to manipulation and external influences. Consequently, the public opinion survey method for candidate selection system functions more as a strategic tool for parties than as a genuine mechanism for party democracy. This disconnect from the original purpose of candidate selection highlights the need for a fundamental redesign of the system — one that goes beyond formal openness to ensure the substantive realisation of substantive democracy, responsible public participation, and genuine political representation are realised.
